HC notice to govt on PIL for probe into deaths at Pulwama hospital

Srinagar, May 27: The state high court today issued notice to government on a Public Interest Litigation, seeking an inquiry by crime branch into the deaths of four pregnant women at district hospital Pulwama in south Kashmir in March this year.
A division bench of chief justice N Paul Vasanthakumar and justice Dhiraj Singh Thakur issued notices, returnable in six weeks, to Government through Chief Secretary, Commissioner Secretary Home, Director General of Police, CMO Pulwama and a lady doctor.
The PIL has been filed by one Iqbal Rasool whose step mother died allegedly due to medical negligence in March this year.
"Four deaths of similar nature had already been caused by the lady doctor. (My) mother was operated but some instrument was kept inside the operated portion for which reason she continuously bleeded but the doctor and other staff did not care for entire night," the petitioner said.
He said that his mother was again taken to the operation theatre to remove the leftover instrument but she died.
"Police filed an FIR but no action was taken. While public revolted against district administration after newspapers reports, the administration announced to transfer 65 officers to pacify the situation but later on the same proved out to be a white lie," he said.
The petitioner has sought direction to the crime branch to register a case and enquire into the deaths of the pregnant women allegedly at the hands of the lady doctor.
Apart from this, the petitioner seeks directions to the government to furnish the list of the doctors along with their qualification experience who are posted and are serving at the place of their postings in the district hospitals in the Kashmir valley in particular of district hospital Pulwama so that the court is informed whether the health care is at par with what is available in Srinagar.
"If it is not at par with the court may in accordance with the mandate of the J&K constitution direct them to post the experienced and qualified doctors in the other districts," the petitioner said.
The petitioner prays court to call for the record of qualification of the doctors appointed under the National Rural Health Mission and seek their counter check by constituting an expert committee.
"The court may directed (government) to constitute a special team in collaboration with each other to have surprise checks of all hospitals and the private and government nursing homes, and the associated hospitals of medical colleges and the SKIMS etc all over the valley, and prepare the list of the facilities available for the patients of all types besides the list of the doctors actually working there, and the details of their qualifications and the experience," the petitioner said.
The petitioner also seeks direction to the state and its concerned authorities to provide adequate medical care as per the constitution in the remote and the rural areas.
