DB grants bail to 8 involved 'Mendher murder' case

Jammu, May 29: A Division Bench of State High Court comprising Justice Hasnain Massodi and Justice Janak Raj Kotwal today awarded life imprisonment by the Trial Court in much publicized Broad Day Light Murder case and granted bail to eight accused namely Mehraj Din, Anwar-ul-Haq, Saraj Din, Mohd Mehboob, Makhan Din, Baz Hussain, Umer Bakesh and Abdul Majid with the direction that they shall be released after each of them furnishes a personal bond in the amount of Rs.50,000/- along with surety in the like amount to the satisfaction of the Registrar Judicial of this Wing.
After hearing Sr Adv Sunil Sethi with Adv Ravi Aborl appearing for the accused the Division Bench while granting bail to the accused persons. It further observed that In this backdrop of legal position, court have read the evidence led by the prosecution before the trial Court in light of the evidence, in particular, evidence of star witnesses namely Abdul Qayoom who is real brother of the deceased and other eye witnesses, we are of the view that sufficient ground for releasing appellant Nos. 2 to 9 on bail pending disposal of this appeal is made out though we would not like to comment more on the evidence at this stage lest that may not prejudice the case of the parties in the appeal.
According to the police case, complainant Abdul Qayoom (brother of the deceased Abdul Rehman) on April 25, 2010 at the Police Station Mendhar alleged that accused Mohd Javed, Saraj Din,Baz Hussain, Mehraj Din, Anwar-ul-Haq, Mohd Nissar, Umer Bakesh, Mohd Mehboob, Mohd Bashir, Mohd Azam, Abdul Majid, Mohd Nazir, Mohd Mushtaq, Makhan Din, Jamal Din, Mohd Naseer, Mohd Din, Mohd Zuffer, Karam Noor and Mst Zahien, are closely related to the complainant who is residing at Dharana Tehsil Mendhar. Case said that one of the accused had borrowed Rs.6,40,000/- from his brother Abdul Rehman alias Haji Khani for purchase of land at Village Ari about one year ago which was to be returned on 31/12/2009 was also agreed by the accused No.2 in many Panchayats; that on the previous day, i.e. on 25/4/2010 Panchayat was fixed at Govt Girls Higher Secondary School Mendhar where the accused 1 to 20 with common criminal intention at about 2.30 PM entered in the said school, the accused 1 to 20 attacked him and his brother with intention to commit their murder and the accused No1 attacked his brother on his abdomen with knife and thereafter the accused raised slogans of joy and also tried to commit the murder of the complainant but the complainant escaped otherwise he too would have been killed.
