DB asks Crime Branch to file latest status of 'CET-2010' probe

srinagar, July 2:A Division Bench of the J&K High Court comprising Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magrey today directed Crime Branch of police to file latest status of its investigation into Common Entrance Test (CET) conducted by Board of Professional Entrance Examination (BOPEE) in 2010.
Hearing a suo-moto Public Interest Litigation (PIL), the Division Bench comprising Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magrey asked the Crime Branch to file details as how it closed investigations into CET of 2009 and 2011 and asked the investigating agency to file report within four weeks.
Meanwhile, the division bench also issued notice to government on a fresh bail application moved by Muhtaq Ahmad Peer, the former chairman of the BOPEE who according to the crime branch is the kingpin in the Common Entrance Test -2012 question paper-selling scam. The High Court already had rejected the first bail plea of the Peer in October last, observing that the investigating agency was still investigating the involvement of other conspirators and therefore at this stage grant of bail shall be detrimental to further investigation of the case regarding other conspirators. Earlier during the last date of hearing, the court had granted two months time to the crime branch for completing the investigation into the CET-2010. Then, the crime branch had sought time claiming that it had to construct record which was damaged by the last year's floods.
When AAG Bashir Ahmad Dar, representing the Crime Branch sought some more time for filing the latest status of the investigation, the Division Bench said, "Two months are over, have you completed the probe but the court granted the crime branch four weeks to file the latest report. "In 2009 and 2011, there was no evidence, therefore the investigation agency was closed," the crime branch had submitted.
"The magnitude of the fraud committed can be gauged from other angle i.e. money power will have preference over all others. The merit, hardwork, genuine hope, expectations and fair selection have become causality," the court had said.
