Court acquits four accused allegedly involved in militancy

Jammu, July 4: 2nd Additional Sessions Judge Jammu M K Sharma acquitted four accused namely Abdul Rahim Wani, Bashir Ahmed, Malook Khan and Mohd Tahir who were allegedly involved in alleged militant activities after prosecution miserably failed to prove its allegations.
After hearing both the sides, 2nd Additional Sessions Judge Jammu M K Sharma observed that entire case of prosecution rests solely on the testimony of police personnel while the independent witnesses cited have either not been examined or those who have been examined have turned hostile.
Thus court is of the opinion that the prosecution case is full of doubts and does not inspires confidence and evidence collected is insufficient to connect the accused with the commission of crime of which the accused are charged. And as challan therefore fails with these observation court acquitted accused of the charges.
According to the police case, on 23/12/2001 at about 7.00 pm a white colour Gypsy without registration number being driven by the accused Qamar Ayoub with other accused on board was intercepted by the police naka party led by Parshottam Kumar Mengi, SHO, Police Station, Nowabad, near Poonch House, Talab Tillo, Jammu. On checking, a red and white rexene bag was found under the driver seat, from which one packet RDX, one hand grenade and a detonator were recovered. SHO prepared a docket in this regard and sent it to Police Station, Nowabad and a FIR No.222/2001 for the commission of offences u/s 4/5 E.S.A, 3/4/5 P.O.T.O r/w section 120-RPC was registered in Police Station, Nowabad. During the course of investigation on 16/01/2002, the accused Qamar Ayub, Abdul Rahim, Bashir Ahmed and Malooq Khan in their disclosure statements stated they have concealed some more ammunition at different places near river Tawi leading to its recovery. The investigation culminated in filing of this charge-sheet against the accused.
