JAMMU, July 30: Second Additional Sessions Judge, Jammu, M K Sharma today awarded two years RI (rigorous imprisonment) to Satinder Singh who was facing trial in an attempt to murder case for the last 11 years. According to police case, Rajesh Kumar was on June 20, 2004 going home of his uncle Baldev Raj at Kotli Arjun Singh, R S Pura, on his motorcycle, with Neetu Devi and Laxmi Devi sitting on the pillion seat, when he was attacked by the accused who were on another motorcycle (JK02T/9028). He was attacked near the Kotli Arun Singh bridge with sharp-edged weapons by Satinder Kumar and Vijay Kumar. Another accused Tilak Raj kicked him, causing him injuries on different parts of the body. Thereafter, the accused fled the spot, leaving Rajesh in a pool of blood. On the basis of complaint lodged by Rajesh with R S Pura police station, FIR No 75/2004 for the commission of offences under sections 324, 323 and 341/34 of RPC and 4/25 of Arms Act was registered. IO Arun Prakash recorded the statement of the injured at GMCH, Jammu, and other witnesses, seized the motorcycle of the accused and inspected the spot. The accused were arrested. During investigation, the weapons of offence were recovered on the disclosure of the accused on June 26, 2004. The weapons were seized and opinion was obtained from the doctor. The investigation held the accused guilty of the crime. The accused Vijay Kumar died during the pendency of the case and the proceedings against him were abated. The judge, after hearing the two sides, observed that the injured had sustained only two simple injuries. The occurrence took place in June 2004 and the trial commenced in July 2004. The convicts faced the trial for more than 11 years. In this background, Satinder is sentenced to RI for one year and a fine of Rs 2,000 for the commission of offence under section 307 of RPC, imprisonment for one month for the commission of offence under section 324 of RPC and imprisonment for one year and fine of Rs 2,000 for the commission of offence under section 4/25 of Arms Act. In case of default in payment of fine, the convict shall undergo further simple imprisonment for 15 days each. The convict Tilak Raj who beat the injured with kicks and blows, did not cause any superficial injury to the injured. He participated in the occurrence in furtherance of common intention. He is, therefore, sentenced to rigorous imprisonment for three months and a fine of Rs 2,000 for the commission of offence under section 307 of RPC and imprisonment for 10 days for the commission of offence under section 324 of RPC. In case of default in payment of fine, the convict shall undergo further simple imprisonment for 15 days. The substantive sentences shall run concurrently, the court directed.(JNF) |
