NOCs granted to allegedly illegal stone crushing units at Reasi
** SIC directs authorities to reveal info under RTI

Jammu, Aug 1: The state information commission (SIC) has directed the PIO in the office of deputy commissioner, Reasi, to forward an RTI application to the concerned authorities so that information is provided under the Right to Information Act to an RTI activist who has alleged that many stone crushing units in Reasi are operating without No Objection Certificates (NOCs) from the departments of I&C department, forest, power amd labour, besides pollution control board.
J L Kaul of Talab Tillo moved an RTI application on January 2, 2015 before the PIO in Reasi DC's office, seeking information on number of stone crushers functioning in Reasi district, name of each proprietor, place where the crushers have been established, whether any crusher is situated within forest area and if so, whether permission has been obtained from the competent authority, whether NOCs have been obtained from all the concerned departments before starting these crushers, copies of such NOCs be provided, whether electric meters have been installed in every crusher, whether their employees have been registered with the labour department and whether agricultural land has been utilised for this purpose.
Feeling aggrieved of inaction on the part of the PIO, the appellant filed first appeal on March 21, 2015 before the First Appellate Authority (FAA), ie Reasi DC and after that the appellant filed second appeal before SIC on June 18, 2015.
The commission after receiving the second appeal listed the matter for hearing on July 22 last. During the course of proceedings,the PIO-cum-additional DC, Reasi, apprised SIC that after receiving the application of the information seeker it was transferred to all the Tehsildars of the District Reasi and the concerned Tehsildars (nine in number) were directed to furnish the information to the information seeker directly as per the RTI Act, 2009. The PIO also submitted that the appellant's first appeal was heard and disposed of under rules. However, the appellant did not attend the hearing before the First Appellate Authority (FAA) despite the fact that he was informed about the date of hearing in advance.
Moreover, the information received from the Tehsildars of Pouni, Mahore, Thakrakote and Chasanna was furnished to the information seeker directly by AC(R), Reasi vide office letter No.DC/Reasi/N/RTI/494 dated 21.05.2015. The PIO submitted that on the basis of report submitted by Tehsildars in District Reasi no other tehsil except the Reasi Tehsil falling under the jurisdiction of District Reasi is having stone crushers and the said information has already been conveyed to the information seeker by the Tehsildar Reasi vide office letter No.80-81/ Teh/RSI/RTI dated 06.02.2015.
During the course of proceedings, the appellant brought to the SIC notice that the information provided by Tehsildar, Reasi has not been consolidated and is haphazardly presented. In view of the request of the appellant, Tehsildar Reasi was directed by SIC to furnish the revised information duly authenticated/consolidated as per the RTI application. However, some of the information sought by him in queries 4, 5 ,6, 7 and 8 in the RTI application do not relate to the Revenue Department and the information is neither available in the DC's office nor in the office of Tehsildar, Reasi and PIO requested SIC that the appellant be advised to approach the Industries Department, Forest Department, Labour Department, Power Development Department and Pollution Control Board of the District Reasi for information relating to the above said queries.
SIC order reads as:
"It is evident that the information available with the Revenue Authorities in District Reasi stands already furnished to the information seeker. However, rest of the information as mentioned in the aforesaid queries raised by the information seeker pertains to the Departments mentioned above. PIO/Additional Deputy Commissioner, Reasi is hereby directed to transfer the RTI application of the information seeker to the concerned Departments. The information seeker is also advised to approach the aforesaid Departments in order to seek information available in their office record. The appeal is accordingly disposed of.
