Widow allegedly manhandled for asking to change road alignment

Kishtwar, Aug 3: In an alleged case of manhandling of a widow in Sirgwari area of Kishtwar by government officials and others, Chief Judicial Magistrate (CJM) Kishtwar directed SHO of Kishtwar police station to register a case against Kishtwar ACR Khalid Hussain Malik, son of Shahid Hussain Malik of Asrarabad, in charge police post Bhatnanagar Thakrie Qasim Din, son of Karim Khan of Anjol and four others including Babli Devi wife of Late Balwan Singh resident of Bhatnanagar Thakrie presently working as SPO at PP Bhatanagar, Hari Ram son of Amar Chand, Jarnail Singh son of Jodh Ram both resident of Filler Thakrie and Nek Ram son of Chand Ram resident of Trera Pakalan.
As per the details available with Early Times, the incident took place on 28-07-2015 and after getting dejected as police fail to give justice to the victim, she today approached the CJM's court through her counsel with the prayer to direct Kishtwar police to register an FIR against the accused ACR Kishtwar and five others who were allegedly involved in manhandling her in full public view. As per the complaint filed by 65 year old widow, on 28-07-2015, the above named accused with common criminal intension come to Dalwas Pakalan where the residents of village Sirgwari were agitating to save their life and property as the contractor and the authorities of PMGSY were hell bent to construct the road namely Shiv Nagar-Srawan by throwing the debris allegedly over the house of the complainant and other residents, added that the complainant along with other villagers; mostly women were raising objections and were demanding to change the alignment of the road keeping in view of the threat to their life and property.
The complainant allege that at about 6 PM on the same day, the accused persons appeared at the spot and instead of paying any heed to the requests of the complainant and other villagers allegedly started manhandling, beating and abusing the complainant and other villagers.The complainant alleges that accuse No. 1 (ACR Kishtwar) threaten that he will order for opening of fire on her and others, added that on the instruction of ACR Kishtwar, all the accused thrashed and mercilessly beat the complainant and other villagers; especially women and tried to outrage the modesty of the complainant and other ladies while in between the accused ACR Kishtwar and other male accused caught hold off her from her breasts and thus outraged her modesty.
The complainant in her complaint allege that the matter was also brought into the notice of Kishtwar police, but nothing was done despite the fact that matter was widely reported by the media along with photographs. She prayed the court to issue necessary directions under section 156 (3) Cr. PC to Kishtwar police to register a case Under Section 427/323/354/504/506 RPC against the accused and punish them under law in the interest of the justice.After hearing the complainant and her counsel, the CJM directed Kishtwar police to register case against the accused and report the court.
"Heard and considered the arguments. The instant application is forwarded to investigate the matter in terms of application under law and report" stated the CJM Kishtwar order issued vide No. 867/CJMK dated 3-08-2015.
It is pertinent to mention that the people of village Sirgwari and its adjoining areas joined by the people of Kishtwar District also held a strong protest at Kishtwar against the alleged atrocities committed by police and officials on women flock in Sirgwari village in which at least five women were received injuries. The people also block the road outside Deputy Commissioner Kishtwar office and raised slogans against ACR Kishtwar who order for use of police force against the villagers and demanded his arrest along with others. The issue was later address after ADC Kishtwar Mohammad Hanief Malik on the direction of DC Kishtwar visited the spot and found the concern of villagers as genuine and issued on spot direction to PMGSY and contractor to ensure safety and security of lives and property of the villagers.
