Masarat Alam re-arrested just after release

Jammu, Sept 1:Circumventing the J-K High Court's order on the release of separatist leader Masarat Alam, the J-K Police on Tuesday re-arrested him "on the gates" of Kotbalwal jail in Jammu seconds after his release. The J-K High court last month had quashed his detention under the Public Safety Act (PSA) and ordered the government to release the separatist leader. "He (Alam) was released after we provided a copy of the High Court order to the jail authorities today," said Muslim League spokesperson Mohammed Rafiq Ganai. "But even as he was yet to come out of the jail, a few policemen, who were already presented inside the jail, arrested him again." Ganai said that Alam was taken to an undisclosed location. "We have no information about him and Police also is not telling us anything. We are worried for his safety," he said. "Police have waged a war against the Muslim League leaders and activists. They (leaders) are being arrested and harassed by the men in uniform." A bench of Justice Hasnain Masoodi, while quashing the detention under Public Safety Act against Alam, last month had said that Alam detention was "undemocratic and repugnant to rule of law". "It violates fundamental principle of Criminal Jurisprudence providing for presumption of innocence of accused till he is proved guilty on fair and transparent trail," the court had observed. The release of Alam in March this year, after spending four years in Jail, had triggered a political row in Kashmir. The People's Democratic Party, which came under pressure from the BJP and the centre government, rearrested Alam on April 17 for "sedition" and "waging war against the state". Alam had raised pro-Pakistan slogans in a separatist rally on April 15 - where Pakistani flags were also hoisted - organized to welcome Hurriyat chairman Syed Ali Shah Geelani in Srinagar.
