Court convicts LeT militant in Udhampur blast case

Jammu, Sept 1: Principal Sessions Judge, Udhampur, R S Jain today convicted LeT terrorist Abdul Majeed, son of Shahab of Behrote near Thannamandi, Rajouri, for his involvement in the 2011 Udhampur bomb blast case.
According to the prosecution case, he and accused Ghulam Sarvar are LeT terrorists, having links across the international Border and have been carrying on terrorist and disruptive activities in J&K with a view to cause secession of the state which is part of the Indian Union and create terror in the minds of people as well endanger the security of the state and disturb the public tranquility and in furtherance of this purpose, they entered into a criminal conspiracy and caused an explosion with an intent to strike terror among the people and endanger the lives of security forces and civilians and likely to cause death and which actually resulted in a death of one person as well injuries to other persons and damage to public property.
In pursuance of this conspiracy, on May 2, 2011 at 8.30 am at Dhanori near Birma bridge on the national highway, Udhampur, Ghulam Sarvar, in a Maruti car No DL3CF/8035 purchased by Abdul Majeed, kept RDX and detonated it with a remote control. In the explosion, Kuldeep Kumar died on the spot and 6 others sustained grievous injuries. One army Ambassador car was also damaged in the explosion. FIR No 83/2011 was registered at Udhampur police station. On conclusion of the investigation, the IO, finding the accused guilty of offence under sections 302, 307, 324, 326 and 120-B of RPC read with section 3 of Explosive Substance Act and Section 16/18 of Unlawful Activities (Prevention) Act, presented challan against the accused in the court of law. While Sarvar could not be arrested, proceedings under section 512 of CrPc were initiated against him.
The judge, after hearing the two sides, observed that the prosecution had been able to prove and establish the necessary intent and knowledge of Majeed in criminal conspiracy with Sarvar (as contemplated under Section 300 of RPC) to commit the murder of Kuldeep Kumar and an attempt to murder many other persons as he along with other accused Sarvar could in pursuance of the criminal conspiracy with known and unknown person/persons and thus caused the explosion with an intent to strike terror among the people and endanger the lives of security forces and civilians. The court held Majeed guilty of offence under sections 120B read with sections 302, 307, 326 and 324 of RPC and section 3 of Explosive Substance Act and Section 16/18 of Unlawful Activities (Prevention) Act.
The court accordingly convicted him and sent him to judicial custody and fixed September 3, 2015 for the arguments on quantum. (JNF)
