BMO Dachan put on penalty notice by SIC

Jammu, Sept 2: As the former Block Medical Officer Dachan in Kishtwar district (now attached )failed to dispose off an RTI application within the stipulated time , the State Information Commission (SIC) has taken serious note of it and the said officer has been served with penalty notice. Not only this, the Directorate of Health Services Jammu has attached the said erring officer with Medical Superintendent District hospital Kishtwar.
Details available with Early Times reveal that one Abid Hussain Lone, S/O Gh.Rasool Lone R/O Dehraie Marwah, Kishtwar filed an application dated 06.03.2015 before the PIO / Chief Medical Office (CMO), Kishtwar under J&K RTI Act 2009 wherein he sought some information related to some employees working in the office of the Block Medical Officer, Dachan.
The Chief Medical Officer, Kishtwar transferred the said application vide office No.CMO/K/8174 dated 06.03.2015 to the BMO, Dachan with the request to provide the desired information directly to the applicant under intimation to his office. The appellant feeling aggrieved of inaction on the part of the Block Medical Officer, Dachan filed first appeal dated 06.04.2015 before the First Appellate Authority/Director, Health Services, Jammu and after that appellant filed second appeal dated 30.06.2015 before the State Information Commission (SIC)
The counter-statement filed by Deputy Director Health Services,(HQ), Jammu vide office No.DHSJ/PIO/4969-71 dated 18.08.2015 reads that the Block Medical Officer, Dachan vide letter bearing No.BMO/D/NHM/151-53 dated 14.05.2015 communicated that information was prepared and has been dispatched to the information seeker vide letter No.BMO/D/NHM/76-78 dated 20.04.2015 through registered post. The Deputy Director, Health Services (HQ), Jammu further submitted before SIC that the postal receipt submitted by the Block Medical Officer, Dachan was bearing the date of post as 12.05.2015 making it apparent that there was delay of almost thirty five days in providing the information to the information seeker and as such, the First Appellate Authority (FAA) vide letter bearing No.DHSJ/Ist Appeal/1649-50 dated 19.05.2015 directed the Block Medical Officer, Dachan (Dr.Mehboob Iqbal Khan) now attached with the Medical Superintendent, District Hospital, Doda to explain reasons for inordinate delay in providing the information to the information seeker which he has not provided till the letter from FAA was dispatched to him ie 91.5.2015.
The First Appellate Authority also admitted that the appeal filed by the appellant due to non submission of reasons by the Block Medical Officer, Dachan could not be disposed of and is pending for disposal. The Commission after receiving the second appeal listed the matter for hearing on 03.08.2015 and 19.08.2015. On 03.08.2015, the appellant was present in person and apprised the Commission that the information provided to him by the BMO, Dachan was incomplete, incorrect and misleading
"In view of the aforesaid facts and observations, the Chief Medical Officer, Health & Family Welfare, Kishtwar and Block Medical Officer, Dachan(Kishtwar) are hereby directed to furnish the revised information to the information seeker severing such information which is purely personal in nature and is likely to affect the privacy of any person such as service book record and salary statement of the employees etc. free of cost within ten days from the date of receipt of this order under an intimation to the Commission. Block Medical Officer, Dachan (Dr.Mehboob Iqbal Khan) now attached in the office of Medical Superintendent, District Hospital, Doda is hereby directed to show cause why penalty under Section 17 of J&K Right to Information Act, 2009 may not be imposed upon him for his failure to furnish the requisite information to the information seeker within the prescribed period as provided under Section 7 (1) of J&K Right to Information Act, 2009 within two weeks from the date of receipt of this order".
