PIL regarding cancellation of Mining lease from River Ravi

Jammu, Sept 4: In a Public Interest Litigation filed by one Social Activists Ankur Sharma seeking direction to respondents for cancelling the Mining lease/quarrying permit for River Ravi issued under J&K Minor Mineral Concession Rules, 1962, also seeking direction for restraining the Government of Jammu & Kashmir from issuing any Mining Lease/Quarrying Permit for River Ravi till the river Ravi and its attending environment are restored to sustainable levels or appoint a committee of experts functioning under the direct supervision of this Court to study and submit a comprehensive report about the effects and scope of mining in River Ravi and based upon this committee's report, restrain the Government of Jammu & Kashmir from issuing any further Mining Lease/Quarrying License for River Ravi till the river Ravi and its attending environment are restored to sustainable levels.
In the PIL petitioner also seeking direction to respondents to cancel the Consent Orders issued by it to the Stone Crushers operating in river Ravi under Sections 25/26 of the Water (Prevention & Control of Pollution) Act, 1974 and under Section 21 of the Air (Prevention & Control of Pollution) Act, 1981 and for framing and notify the new Minor Mineral Rules within a reasonable time period which are required to be put into force under the 'ratio' of the Supreme Court judgment in Deepak Kumar V/s. State of Haryana, also seeking direction to the State Vigilance Organisation (SVO) to conduct a thorough investigation and file periodic Status Reports before this Court into the abuse of official position in the grant and renewal of Mining Lease/Quarrying Permits for river Ravi, inaction of the public servants in preventing environmental damage and also the grant of consent orders to Thirty One stone crushers in a concentrated zone nearly thickly populated areas.
A Division Bench of State High Court Comprising Justice Muzaffar Hussain Attar and Justice BS Walia after hearing petitioner Aknur Sharma in person issued notice to Law Secy, SVO, DC Kathua & ors and directed to file response before next week.
