HC seeks details of engineers posted along Jhelum since 1996

srinagar, Oct 3: A division bench of the state high court has directed commissioner Secretary I&FC department to provide details of all engineers who remained posted in the areas through which river Jhelum flows from 1996.
"The place of posting with the tenure of posting be also provided," the division bench of Justices Muzaffar Hussain Attar and Ali Mohammad Magrey said and directed the officer to provide complete address of all these engineers to the court's Registry within four weeks.
Hearing a public interest litigation, the division bench also deferred consideration of the replies filed to show cause notices by engineers posted along the area through which Padshahi canal, an age old irrigation canal flows.
The engineers had filed their response to court's notice, asking them show cause why they shall not deposit Rs 25 lakh each for dereliction of duty with regard to maintaining and preserving of Padshahi canal.
On previous hearing, the court had observed: "We are prima facie satisfied that there has been absolute dereliction of duty and connivance of the concerned engineers with the encroachers, which has resulted in near extinction of the Padshahi canal."
The court's efforts to preserve and protect the water bodies, the division bench had said will not bear fruits until such time, the officers, who are in position at the moment, learn to respect the laws.
The division bench had observed some stringent action was required to be taken against those who remained posted in the areas through which Padshahi canal runs.
The division bench also reiterated all the directions issued from the time to time in the PIL filed by one Molvi Peer Noor-ul-Haq, seeking directions to restore the Padshahi canal to its original width.
Among others, the court has directed the authorities to remove encroachments from water bodies including the river Jhelum. The court also directed deputy commissioners of Anantnag and Pulwama to file fresh status report about the latest action taken in removing the encroachments.
