Early Times Report Jammu, Oct 6: The Jammu and Kashmir Higher Education Department is learnt to have been helping the College Principal, who had dragged the department in court and had secured a stay on her transfer order, issued by department. Surprisingly, after spending time and money to fight case against College Principal in court of law, when the department won the case, it started taking side with petitioner and has failed to get its own order implemented. Documents in possession of Early Times revealed that the JK Higher Education department had ordered transfers of College Principals and according to one such order 473-HE of 2014, dated 14/10/2014, Dr. Anita Sudan was transferred from MAM College Jammu to Government Degree College (GDC) Samba vice Dr. Ramesh Chander, who was transferred to MAM College. Sources said that Dr. Ramesh Chander joined the MAM College on October 14 and Dr. Anita Sudan was relieved from the college but she went into court of law against the transfer order of department alleging premature transfer and secured stay from Court on October 16 last. They further said that despite joining of MAM College, Dr. Ramesh Chander was asked once again to join at GDC Samba, on the written order of Nodal Principal, till stay order was vacated. "The department contested case in the court of law and after wastage of time and money on legal counsels, the department after nearly one year, on September 10, 2015 won the case", sources said, adding that Jammu and Kashmir High Court Justice Tashi Rabastan on September 10, 2015 vacated the stay order, while dismissing the petition filed by Dr. Anita Sudan. As per the transfer order of 14/10/2014, vide order No. 473-HE of 2014, Dr. Ramesh Chander is to join MAM College, but after lapse of nearly 25 days since stay is vacated, Dr. Ramesh Chander is still in GDC Samba, while Dr. Anita Sudan is enjoying posting as per her desire in MAM College, enjoying strong political influence. Sources further alleged that higher officials have been shielding the Principal, who had gone against department in court of law. "The failure of department to transfer Dr. Anita Sudan only reflects the helplessness of department and political intervention in transfer orders", sources said, adding that onus was on department to take right call, but possibilities were very bleak. |
