A big step forward towards radicalization
Beef party at official MLAs hostel
10/9/2015 12:31:11 AM
Early Times Report
JAMMU, Oct 8: Independent MLA from Kashmir Engineer Rashid on Wednesday crossed all the lines. He challenged not only the justice system but also the Jammu & Kashmir High Court by hosting a beef party not at his private residence but at the official MLA hostel in Srinagar. He in a most brazen manner initiated the process that would further radicalize the already highly radicalized Kashmiri society and motivate the Kashmiri people to defy the law of the land by slaughtering cows and promoting beef eating not only in the Valley but also in certain other areas of the State. To outrage the religious sentiments of the Hindus, the fanatic served his Muslim guests beef kebabs, ristas (meat balls) and beef patties. He felt jubilant over the communal event.
Rashid didn't stop just there. He explained why did he host beef party? He said he hosted the beef party to send a message that no courts or legislature could prevent the people (read Muslims) from eating what they wanted. "Nobody on earth, no Assembly, no court and no institution can stop us from having what we want to have," he said. And what he said surely constituted a contempt of court.
It needs to be noted that Sections 298 A, B, C and D of the Ranbir Panel Code (RPC) are very much in force even today, notwithstanding the Supreme Court's direction that suspended the order of the Jammu Bench of the High Court on ban on cow slaughtering and beef eating for two months. Since Section 298 is still in force, it cannot be violated by anybody. It is the duty of the State Government to enforce the law. People may interpret the Supreme Court direction in the manner they wish, but the fact remains that Sections 298 A, B, C and D are very much intact and their violation must warrant criminal proceedings, as the violation of any of the provisions has the potential of offending the religious sentiments of the Hindu community.
That the fanatic hosted beef party at the MLA hostel should leave none in any doubt that he enjoyed the backing of certain powerful quarters in the establishment and it became clear today when all the Kashmiri parties stood behind him and demanded action against those who sought to create an impression that they didn't approve the beef party or what Rashid did on Wednesday. The very fact that he was not booked for violation of Section 298 A, B, C and D of the RPC that ban cow killing, sale of beef and beef eating is a proof that there were elements in the establishment who allowed him to do what he did to further radicalize the Kashmiri society and tell the powers-that-be in the State and at the Centre that Kashmir was not part of India and that it had its own legal system that was different from the Indian legal system or the Jammu & Kashmir legal system. But more than that, the beef party that he organized at the MLA hostel exposed the power hungry BJP's double-speak on the issue.
Where are those in the BJP who had declared that they would not allow anyone in the Valley to take the law of the land into their hands and that those who would violate the law will be brought to justice? They had only hurled hollow threats like before and they exposed themselves by allowing the Law Ministry to fire Additional Advocate General and Deputy Advocate General for their role in the High Court that resulted in the issuance of order asking the State police to enforce Section 298 A, B, C and D. The BJP wants to enjoy power at whatever cost and that's the reason Rashid, who violated the law at a public place, went scot-free.
Now that Rashid has violated the RPC, it is hoped that the J&K High Court will take suo-motto notice of what this law-breaker did so that the rule of law is maintained in the State. It must be underlined that no-action against Rashid would only create anarchy and lawlessness not only in the Valley of secessionists and communalists but also in Jammu region. Action has to be taken against Rashid and those who participated in the beef party organized at the Government MLA Hostel.
As for the BJP, less said the better. Suffice to say that it is using the beef issue in Bihar to capture power and it is sacrificing its own men, who want enforcement of ban on beef, for retaining control over power in Jammu & Kashmir. Both things are happening simultaneously and only the BJP could do it. The activities of a BJP MLA in the Assembly today were simply an attempt to divert the people's attention away from the misdeeds it had committed after March 1.
