Kishtwar, Dec 20: The high court has initiated contempt proceeding against Deputy Commissioner, Kishtwar, Ghulam Nabi Balwan and Naib-Tehsildar (NT), Pathernaki, Aziz Mohammad for the non-compliance of a stay order granted by Justice Mohammad Yaqoob Mir on the transfer of NT Mehraj-ud-Din of Dool, who was shifted from Kishtwar to a far flung area of Marwah. His transfer order was stayed by the court on medical grounds. As per the details available with Early Times, Assistant Register of High Court, Jammu, has issued a notice for appearance of Balwan and Aziz Mohammad vide contempt No 490 of 2015 in SWP 3141/2015 and directed them to appear in the court in person or by daily authorised attorney or agent on January 15, 2016 to answer all material questions related of the case. The petitioner knocked the doors of HC after Aziz Mohammad allegedly refused to acknowledge the court order and kept the office of NT, Kishtwar, locked. Meanwhile, vide order No 181-Rev of December 18, 2015 issued the modification of order No 169 Rev of December 2, 2015 and posted the petitioner against the available post of I/C NT, ARA, to DC, Kishtwar, the post related to handling of legal matters pertains to district Kishtwar. Mukthar Ahmed attached with Divisional Commissioner, Jammu, office was posted as NT, Marwah, in place of the petitioner while Ghulam Nabi Lone was posted as NT, Pathernaki, and upheld the transfer of Aziz Mohammad as NT, Kishtwar despite court order. The high court had stayed the petitioner's transfer on medical grounds and directed the revenue commissioner and the deputy commissioner, Kishtwar, to allow him to continue on the present place of posting and kept the order No 169-Rev of December 2, 2015 to the extent it pertains to petitioner in abeyance. |
