Pahalgam: SIC asks DC to hold probe into Tehsildar's statement

Anantnag, Feb 6: The State Information Commission has urged the deputy commissioner Anantnag to hold enquiry into the statement of tehsildar Pahalgam who told an information seeker that the records sought by him were destroyed in floods.
Details available with Early Times reveal that Information seeker Mohammad Ashraf Shah, a resident of Zaigund Sallar Pahalgam district Anantnag had filed an application before PIO in the DC office Anantnag on 11.8.2015 but PIO failed to provide information under norms of RTI Act 2009. Thereafter, applicant filed 1st appeal before the First Appellate Authority (FAA) ie Additional DC (ADC). The FAA/ADC Anantnag failed to provide the required information. Shah accordingly filed 2nd appeal before SIC , requested the Commission to take appropriate action against the officials as per provisions of RTI Act.
The information seeker vide his RTI application addressed to PIO Deputy Commissioner, Anantnag, had sought Xerox copies of records pertaining to two PRC's, which he attached with the application form on 11.08.2015. This application was transferred to Tehsildar Pahalgam by Assistant Commissioner Revenue (ACR) who is the PIO in D.C. Office Anantnag on 17.08.2015 under Section 6(3) of the Act requesting him to provide the desired information to the applicant directly under intimation to his office. In response to the notice of the State Information Commission (SIC), Tehsildar Pahalgam filed reply on02.09.2016 stating that the information regarding two PRC Files was delivered/dispatched to the applicant vide his office letter dated 28.09.2015. He said that record of said two files was not traced by team constituted for the purpose and same was communicated to the Vigilance Organization vide office letter dated 28.09.2015 . As regards the record of two said files, the Deputy Commissioner Anantnag vide his office letter dated 02.12.2015 communicated as under:
"The dispatch register pertaining to year 2002-2003 was being kept in round floor of this office and stands damaged due to devastating floods of September 2015. The PRC vide No.863/PRC of 2009-2010 has also been again duly processed and submitted by the Tehsildar Pahalgam vide his No.863/PRC of 2009-2010 and issued by this office in favour of said applicant. But the original file has been returned to Tehsildar Pahalgam vide this office no.851 dated 21.11.2009 through Ab. Rehman (Shali Clerk) of Tehsil Pahalgam for consignment of records"
It is worthwhile to mention that Tehsil office is located at an elevated place in Pahalgam and 2014 floods didn't damage the office at all. Most of the structures in Pahalgam town were also safe during sept floods. The floods occurred in 2014 not 2015 as being claimed by Tehsildar.
SIC order dated 20.1.2016 reads as:
"After hearing the parties and perusal of the records, It is evident that file pertaining to PRC No.863 of 2009-10 has been returned back to Tehsildar Pahalgam under proper receipt on 11.11.2009 through an official of said Tehsil. Now Tehsildar has reported that these records are not traceable, even though as per rules referred to by the DC, responsibility for up keeping of records lies with Tehsildar concerned. In view of the above, the Commission directs Deputy Commissioner Anantnag:-
a) To hold an enquiry into the matter, fix responsibility and take appropriate action against the defaulting persons , b) Direct concerned Tehsildar to rebuild the record within a specified period, as issue of PRC without supporting records is a serious matter. An intimation in this regard be sent to the Commission. With the above directions, the appeal is disposed of".
