Magisterial probe ordered into youth's 'mysterious' death, people protest

Kishtwar, Feb 8: Agitated by the 'mysterious' death of a 35-year-old youth, the inhabitants of Ghurian area of the district today placed his body outside the office of deputy commissioner here and held a protest.
While police denied the allegation, the DC, Kishtwar, ordered a magisterial probe to ascertain the cause of death of the youth.
Shabar Ahmed (35), son of Shah Wali of Ghurian, was sent to police custody by CJM, Kishtwar, on January 25, 2016 in connection with an FIR registered against him under sections 323, 354, 452, 504 and 506 of RPC by Kishtwar police on court direction. The court had, however, granted bail to his wife who was co-accused in the complaint filed by her cousin sister and the latter's husband.
After taking his custody, senior officers came to know that he was suffering from abdominal pain as he had also got himself medically examined at the district hospital, Kishtwar, which was recorded in the official record of the hospital vide MRD No 11520 dated January 25, 2016 . The time of admission, as shown in the hospital record, was 3.10 pm.
While he had abdominal pain and was to be treated in the emergency ward, the doctors allegedly refused to admit him, terming him fit for recording his statement.
Police, during two days of his custody, shifted him to hospital for medical check-up thrice and every time the hospital authorities refused to admit him before he was granted bail by the court on January 27, 2016.
Soon thereafter, he was admitted by his family members to hospital from where they later shifted him to GMCH, Jammu, where he died on February 6, 2016 during his operation.
Sources said his wife lodged a complaint with the court against 10 persons including Irshad Ahmed, son of Shah Wali, Bilal Ahmed, son of Bashir Ahmed, Jaffar Shabir, son of Shabir Ahmed, Shakeela Begum, wife of Abdul Latieef, Rubina Begum, wife of Jaffar Shabir, Tahira Begum, wife of Bilal Ahmed, Nazim Din, son of Dil Mohammad, Shoaib Akther, son of Abdul Latieef, all resident of Ghurian, Head Constable Mohammad Ashraf and police constable Abdul Rashid
Sources said after going through the contents of the complaint filed by her, the CJM, under section 202 of Cr.PC, directed Additional SP, Kishtwar, to conduct the inquiry and submit the report in court. The ASP received the copy of the complaint forwarded to him by the court on February 5, and before he could start a probe, the youth died at GMCH, Jammu.
Sources said the youth, who was responding to treatment, suddenly developed some complicacy and breathed his last.
His brother who is accused in the complaint filed by his wife had also donated him blood while he was undergoing surgical operation. He is survived by wife and five minor children. He was working as a labourer. He was later laid to rest at his ancestral graveyard in the village.
The DC, Kishtwar, provided Rs 10,000 to the victim's family out of Red Cross fund.
As soon as the dead body reach Kishtwar, people protested and a bandh was also observed with demanding a probe into the youth's 'mysterious' death.
The people were pacified after the DC ordered magisterial probe vide his order No 746-49/DM/K dated February 8, 2016 and entrusted the inquiry to ADC, Kishtwar, Kishori Lal Sharma, directing him to submit the fact finding report within 10 days.
Meanwhile, police have initiated inquest proceedings under section 174 of CrPC.
