Info denied under RTI: SIC upholds JU order

Jammu, Feb 9:The State Information Commission (SIC) has upheld the orders of the Jammu University (JU) wherein an information seeker was denied information when he sought the reasons regarding BED course which is completed in one year in Kashmir region and two years in jammu region.
Details available with Early Times reveal that one Rakesh Kumar R/o. Shiv Nagar, Jammu filed an RTI application dated: 01.09.2015 before PIO, University of Jammu. He received a response dated: 19.09.2015, but was not satisfied, as he didn't receive answer to one of his queries. Thereafter, he filed First Appeal on 28.09.2015, but again he didn't receive satisfactory answer. Finally he filed 2nd appeal before SIC.
Vivek Slathia, PIO, University of Jammu filed counter statement before SIC to the 2nd appeal dated: 04.01.2016, stating that reply received from various sections of the University has been forwarded to the appellant vide annexures enclosed with the reply. PIO said that First Appeal has been decided on 08.10.2015, directing the concerned to provide information to the appellant.
The PIO further stated in his statement that reply from Assistant Registrar (CDC) was received on 13.10.2015 and reply from Assistant Registrar (Acad) was received on 16.10.2015. This information could not be provided in time to the appellant, due to the reason that said documents had got attached inadvertently with some other documents by the official assisting in the RTI section. The information was provided to the appellant on 30.12.2015.
During proceedings held on 14.1.2016 , the appellant submitted that information sought at point 4 is not satisfactory, wherein, he wants to know as to who will provide him certificates and reimburse library security deposited by him in Priyadarshni Institute of Management Science Purkhoo, Jammu where from he passed MBA in session 2011.
The said institution has now been closed down . This has been responded to by the Assistant Registrar (CDC) vide letter No. CDC/2015/4937-39 dated: 13.10.2015, interalia, stating that library fee is to be refunded by the College and degrees and certificates are issued by the Certificate Section of the University in accordance with the statutes.
SIC order reads: "As regards para 3, the appellant has questioned as to why a B.ED course is 2 years in University of Jammu and 01 year in Kashmir University. The appellant is informed that seeking justification/reasons for a policy matter is not covered under the definition of information as per section 2(d) of J&K RTI Act, 2009. As regards other queries of the RTI application, information asked has been given.
The PIO, University of Jammu is further advised to furnish attested copies of the information sought by the appellant within one week from the date of receipt of this order. With the above directions, the appeal filed before the Commission is disposed of."
