CBI frames charges against bank manager, others in fraud case

Jammu, May 1: Special Judge Anti-corruption, (CBI cases), Vinod Chatterji Koul has framed charges against then chief manager of Bank of Baroda's Gandhi Nagar branch and others, including a patwari, in a fraud case.
The charges were framed under section 120-B read with sections 420, 468 and 471 of RPC and section 5(2) read with section 5(1)(d) of J&K Prevention of Corruption Act 2006 against Tilak Raj Dogra, then chief manager of Bank of Baroda, Gandhi Nagar, patwari Des Raj, bank's credit officer Jaswant Singh and Said Mohammad, son of Nazim Din, for allegedly commiting a fraud with the bank.
Said Mohammed approached the bank for a loan of Rs 24.87 lakh for setting up a Bee Keeping unit, sponsored by KVIC under REGP, at Birpur near here. He got prepared a forged project report from M/s Suresh Ajit and Associates, Gandhi Nagar, to avail the loan. The pre-inspection report was prepared by Jaswant Singh on June 15, 2007 in which he projected requirement of the borrower for term loan as Rs 21.37 lakh against the requirement of Rs 20.12 lakh and working capital of Rs 3.50 lakh. It was falsely mentioned by him that the proposed loan was secured by mortgage of commercial land measuring 5 kanals worth Rs 46 lakh at Kartholi in Samba. In reality, the land was not commercial. Though it was part of a running nalla, he recommended sanction of term loan of Rs 21.37 lakh and a cash credit limit of Rs 3.50 lakh to the borrower.
It is alleged that after preparing the pre-sanction inspection report, Jaswant, in connivance with Tilak Raj and valuer H R Phonsa, obtained a valuation report of the property mortgaged for exact valuation of Rs 46 lakh on June 17, 2007. Tilak Raj had already obtained a favourable Legal Scrutiny Report from advocate V K Chopra on June 11, 2007 and the loan was sanctioned by him on June 21, 2007.
Said Mohammad had purchased the 5 kanala of land at Kartholi from one Kuldeep Singh, son of Ananta of Kartholi, allegedly against a sale deed of Rs 1 lakh. It was found to be a Gair Mumkin Kassi land. Navneet Gupta, an independent valuer, inspected the land and submitted in his report that it was an open area in the form of a nullah (khad) where water was flowing. Hence the value of land could not be assigned. It was established a letter No BR/ADV/2007/145 of July 25, 2007, which was shown to have been sent by Tilak Raj to tehsildar (naib-tehsildar), Samba, through the borrower for recording the bank lien in revenue record and a forged entry of the lien was managed on the back of the letter on August 31, 2007 to show that the bank lien was got marked but in fact no such entry of the lien was marked in favour of Bank of Baroda in the revenue records. The forged lien entry on the back side of the letter was prepared by forging the signatures of the concerned patwari and tehsildar.
Des Raj was then posted as patwari in the office of assistant commissioner, Nazool, Jammu, and not the patwari of Kartholi. So, it was not his duty to make the lien entry in the revenue records. That he had prepared and forged the lien report was confirmed by FSL, Srinagar, vide its report No FSL-139-Doc-Sgr on November 26, 2014. It was alleged that the conspiracy had been hatched by Tilak Raj, Des Raj, Jaswant Singh, Said Mohammad and V K Chopra, who is no more. (JNF)
