Jammu, May 2: In a petition filed by Amarnath Choudhary, who is alleged to have cheated people who had invested in the Palm Island Mall here, for the quashment of FIR in the case, high court judge Mohammad Yaqoob Mir today appointed retired sessions judge S S Sarangal as a mediator. Observing that the counsels for the parties had agreed to resolve dispute with the investors, the judge appointed retired district judge S S Sarangal as a mediator for settling and monitoring the process. Any other investor in addition to the intervenors would also be at liberty to appear before the mediator. This was done to save the investors from any unnecessary litigation. It was also made clear that inter se disputes between the owners and the developer would be strictly governed by the terms of agreement as had been executed by them on January 29, 2008 and for resolution of any such dispute, they would also be at liberty to resort to clause 49 of the agreement.The fee of the mediator was fixed at Rs 60,000. Rs 30,000 would be paid by the owners and Rs 30,000 by the developer. The mediator would notify the date for meeting of the parties and finalise the process with promptitude, the court directed. The court said the mediator would submit his report in the week commencing June 27, 2016. It also said that the proceedings of the case registered by crime branch would remain in abeyance. Petitioners -- Mohini Devi and Amar Nath Choudhary -- are already released on bail whereas petitioners -- Radhey Shyam and Kaka Ram - would furnish bail and surety bonds to the tune of Rs 1,00,000 each to the satisfaction of Registrar Judicial, the court said.
