Jammu, May 3: In a petition filed by a candidate, high court judge Janak Raj Kotwal has stayed the impugned selection process of lecturers in physical education. The petitioner submitted that recommendations made in government order No 252-HE of May 30, 2012 had not been incorporated in the relevant rules and marks obtained by candidates in written/screening test had not been taken into consideration while preparing the select list. The government order, however, inter alia provides that marks obtained in written/screening test had to be taken into consideration for making selection. It was pointed out by the petitioner's counsel that the selection list published by PSC vide notification 01-PSC(DR-S) of February 2, 2016 clearly showed that it had been prepared in accordance with Rule 51(v) of the J&K PSC (Business and Procedure) Rules, 1980, which in its original form, does not provide for giving weightage to the marks obtained in the written/screening test. Justice Kotwal observed that there was sufficient reason to believe that marks obtained by candidates in written/screening test had not been taken into account as it was required to be done pursuant to the government order No 252-HE of 2012. The court then stayed the impugned selection list and issued two weeks notice to state and others, directing them to file objections. (JNF) |
