Jammu, May 4: In a petition filed by Sanyog Enterprises Pvt Ltd, high court judge Tashi Rabstan has stayed the GMC principal's order of closure of 24x7 pharmacy shops in government hospitals.
The petitioner has sought the quashment of GMC principal's April 6, 2016 order No GMCHJ/PS/Shops/1085 and a direction to the respondents to honour the terms of the contract and give suitable shops in the health institutions on all locations alloted to the petitioner within a reasonable time frame.
The petitioner's counsel submitted that the impugned communication was absolutely silent on the reason of its issuance except for the verbal orders of Managing Director, J&K Medical Supplies Corporation Ltd. As it was issued soon after the replacement of governor rule with elected government and re-allocation of portfolios, it does speak about the intent and reason behind the issuance of impugned communication and that too on the verbal orders of the managing director even as he happened to be one of the signatories to the policy decision.
He submitted that the petitioner had been approaching the respondents to seek enforcement of their commitment after extracting a complete bid amount of Rs. 21.51 cr, the latter were threatening directors and employees of the petitioner company of a series of prosecutions by different anti-graft agencies.
After hearing him, Justice Rabstan issued notices to the health and medical education secretary, MD, J&K Medical Supplies Corporation Ltd, Principal of GMC, Jammu, Principal of Dental College, Jammu, Director Health Services, Jammu, Medical Superintendent of Government Medical College Hospital, Medical Superintendent, Super-Speciality Hospital and Medical Superintendent, Psychiatric Hospital.
Granting a week's time for filing response, the court, subject to objections from the other side, stayed the closure of 24x7 pharmacy shops in government hospitals. (JNF) |
