Jammu, July 27: High Court Judge Janak Raj Kotwal today stayed the suspension order of two government school teachers which had been issued by the director school education (DSE). Talib Hussain and Riaz Ahmad, who were earlier attached with the offices of ZEOs in Doda district, were retained at their present places of posting by the deputy commissioner, but the DSE later suspended both of them for the non-compliance of order. Justice Kotwal, after hearing the counsel for petitioners, observed that it seemed that a clash of powers between two authorities, ie DSE and DC, at a high level, had led to the suspension of teachers. The DC, in his report as sought by the court, gave a detailed account to justify his power to retain the petitioners at their original places. Staying their suspension order, Justice Kotwal asked the chief secretary to look into the matter so that such avoidable situations leading to harsh actions against employees were avoided in future. While Talib was transferred from HSS, Doda, to the office of ZEO, Bhatyas, Riaz was sifted from HSS, Desa, to the office of ZEO, Ghat. The DC, Doda, had issued an order vide his No DDC/Edu-Corsp/14529-32 on February 29, 2016, retaining both of them at their original places of posting till suitable replacement was provided. A copy of this order was also sent to DSE, Jammu. For non-compliance of their transfer orders, the DSE had later placed them under suspension. --(JNF) |
