Jammu, July 29 (JNF): A cheat, who had forged the documents of possession of a plot and a shop site to an ex-serviceman at Sainik Colony here, was today sent to jail for 25 years by first additional sessions judge, Jammu, M A Choudhary. Accused Rajbir Singh, son of Prithvi Singh of Gurah Slathia, was jailed for the offences under sections 420, 467, 468, 471 and 120-B of RPC. He was also fined Rs 50,000. The case against him was registered by the crime branch on the complaint of Thakra Singh, son of Tabeet Singh of Gurha Slathia, Mandi Bagh, Samba, stating therein that he, being an army personnel, became member of the Sainik House Building Society, Sainik Colony, under registration No 5030 and 7939 respectively for allotment of a residential plot and a shop site in the colony and in response to his application, he was allotted plot No 88-F and shop site No GS-246 at Sainik Colony. Against these allotments, he paid the price against receipts Nos 9043 on December 28, 1994 and 9056 on January 9, 2015 . The chairman and other officials of the society assured him that all the formalities would be completed and as and when his presence was required for execution and registration of the lease documents, he would be informed. He alleged that the accused hatched a conspiracy and transferred the plot and shop site in his name by forging the documents. During the CB probe, society's secretary Pritam Singh, who was also allegedly involved in preparing forged transfer documents, expired. As the investigation moved forward, the chargesheet was filed against Rajbir and Nanak Singh, son of Chatar Singh of Colonel Colony, Airport, chairman of the society for the commission of offences punishable under sections 420, 467, 468 and 471 of RPC. The judge, after hearing the two sides, observed that the accused had cheated a soldier who had devoted whole of his life for security and sovereignty of this nation, taking advantage of his simplicity and breached his trust which he had reposed in him by showing him as a nominee at the time of allotment of plot. He had also forged the documents on behalf of complainant under a criminal conspiracy by the functionaries of society, but unfortunately chairman Nagar Singh died during trial and secretary Pritam died during investigation of the case. He awarded imprisonment for a term of five years and a fine of Rs 10,000 for the commission of each of the offences punishable under sections 420, 467, 468, 471 and 120-B of RPC, totalling 25 years of imprisonment and a fine of Rs 50,000. All the substantive sentences of the imprisonment would run concurrently, the judge ordered. |
