Jammu, July 30 (JNF): High court judge Tashi Rabstan has rejected the bail applications of four accused involved in over Rs 2.5 cr ATM theft case. The accused included Suresh Kumar, Sunil Kumar, Pawan Kumar, son of Nek Ram, and Pawan Kumar, son of Des Raj. On May 18, 2016, Jatinder Singh, senior manager of Radiant Cash Management Service Pvt Ltd, had lodged a written complaint with police, stating therein that there was misappropriation of cash in 15 ATMs of SBI at Udhampur. He said during the cash audit and verification on May 17, 2016, it came out that there was cash shortage in 15 SBI ATMs to the tune of Rs 2,52,77,900. Those responsible for all cash operations and handling of ATMs on this route were Sahil Sharma and Vicky Kumar. On receipt of the complaint, a case under sections 409, 403 and 120-B of RPC was registered at police station, Udhampur. Justice Rabstan, after hearing both the sides, observed that as the challan was produced in the court of Chief Judicial Magistrate, Udhampur, it would not be appropriate and in the fitness of things to deal with this application at this stage. It would be appropriate if the petitioners were directed to approach the trial court for grant of regular bail. So far as the allegation of criminal conspiracy under section 120-B of RPC was concerned, the petitioners would be at liberty to address the said issue before the trial court, he said. With these observations, the court rejected their bail applications.(JNF) |
