Inspite of penalty notice by SIC, CMO fails to provide sought information

Srinagar, Aug 23: The Chief Medical Officer (CMO) Bandipora inspite of getting a penalty notice from State Information Commission (SIC) has failed to reveal information about the appointments made in several health blocks of Bandipora district during last several years. The State Information Commission (SIC) had issued penalty notice against Chief Medical Officer (CMO) Bandipora around 7months back as he had denied information under RTI Act about class IV appointments made in Bandipora district from 2006 onwards.
Details available with Early Times reveal that one Ghulam Mohammad Lone a resident of Markoot Gurez Distt Bandipora submitted an application before PIO cum CMO Bandipora on 05.10.2015 requesting for information of Tehsil's Gurez and Bandipora from January 2006 to September 2015.
However, no response was received from concerned officer until 04.11.2015. Accordingly, he submitted First Appeal to Director Health Services Kashmir on 04.11.2015 requesting for a decision, but no response was received up to 19.12.2015. He has accordingly prayed that penalty should be imposed on the concerned for not providing the information under the Act and direct them to provide the requisite information as soon as possible. Information was again denied and information seeker filed an appeal before State Information Commission (SIC)
In compliance to the notice of the State Information Commission, CMO Bandipora filed reply, but information seeker submitted that information in respect of Bandipora has not been provided.
SIC's ruled in its order, "Prima-facie, there is delay in responding to RTI application filed before CMO Bandipora on 05.10.2015. Accordingly, CMO Bandipora is directed to explain as to why penalty proceedings under Section 17 of RTI Act shall not be initiated for delay in providing information to the appellant. His explanation should reach Commission within two weeks. With the above directions, the appeal filed before the Commission is disposed of".
As per information available , Inspite of the orders issued by SIC in March this year the information is yet to be provided to the information seeker. The aggrieved party has sought intervention of State Information Commission once again.
