Channi gang rape victim seeks transfer of case to CBI | HC directs SSP, SHO to file status report | | Early Times Report Jammu, Oct 21 : Not satisfied with the police investigation, the Channi Himmat gang rape victim today filed a petition in the high court, seeking transfer of case investigation to CBI or crime branch. After hearing her counsel, Justice Janak Raj Kotwal issued notices to SSP, Jammu, and SHO of Channi Himmat police station and directed them to file status report. In her petition, she has leveled serious allegations against the police working, urging the bench to ask the Investigating Officer to present himself in the court and conduct his test to check his legal and investigative ability, besides monitoring of the investigation. She also sought registration of FIR against the erring police officers and hospital doctors under sections 166 A and 201 of RPC amended vide Criminal Law Amendment Act. The counsel submitted that the petitioner was gang raped allegedly by Jatinder Singh of Sainik Colony, Sanjay Kumar and Bubby with the help of one Swarna Kumari, but police had so far failed to conduct proper and fair investigation in the case. While Bubby was arrested, the other two were preparing to exonerate themselves of the charges on extraneous considerations for being influential and politically well connected. "Swarna is also influential, therefore the entire investigation is unfair and partial and all out efforts are being made to save the offenders and harass the rape victim," he alleged. Neither the law contained in section 154 was followed by the SSP and the SHO nor investigation till date was going on in a fair and transparent manner, he alleged. He alleged that police were unnecessary delaying the arrest of the accused while causing failure of justice by unfair and shoddy investigation.The victim pleaded that she was receiving threats and allurements from various persons, including a lady and some other persons. "She is being threatened to accept money and settle the matter. She is being intimidated that in case she doesn't toe their line, she will be eliminated or implicated in false cases," her counsel alleged. "She has also submitted a written complaint to the SSP in this regard but no action has been taken by respondent No 4 as he seems to be under pressure or influence of the accused or any political person," he alleged. "Vital evidence has been destroyed or permitted to be destroyed by the police laxity as when she was taken by cops to the government hospital, Gandhi Nagar, neither a medical board examined her nor any doctor. Just a female doctor questioned her verbally and at that time father of one the accused was spotted there with the said doctor who too lives in Sainik Colony where he is an officer bearer of the society. Therefore, the medical report too has been manipulated," he alleged.(JNF) |
