KVIC 'scam': Court rejects CBI's closure report, orders re-probe

Jammu, Oct 22: Asserting that it is not satisfied with the CBI investigation into the alleged KVIC scam, the court of special judge anti-corruption, Jammu, has rejected the closure report filed by the investigating agency and ordered a further probe.
An FIR for commission of offences under sections 120-B, 420, 467, 468 and 471 of RPC and section 5(2) read with section 5(1)(d) of PC Act was registered on the basis of a source information against KVIC's state directors -- B R Chouhan, S R Sagar, Baldari Singh and V S Bhagul - M/s Vitasta Khadi Gram Udyog Sewa Sansthan's secretary Bhushan Lal Ganjoo.
It was alleged in the FIR that from 2010 onwards, the four KVIC state directors had entered into a criminal conspiracy with Ganjoo in pursuance whereof they fraudulently and dishonestly caused loss of Rs 13,75,016 to the government exchequer.
The FIR stated that schemes relating to Marketing Development Assistance (MDA) were executed only on papers on the basis of forged and fabricated records and no raw material was purchased by the NGO. It was alleged that fake and fabricated bills were generated for reimbursement, bank accounts of artisans were not credited with the amount meant for them and in some cases, bank accounts of artisans were not opened at all whereas in some other cases, the particulars of accounts of artisans turned out to be those of old age pensioners. No physical verification was conducted and MDA was released in favour of the NGO with a malafide intention, the FIR alleged.
Special judge anti-corruption, Sanjay Dhar, after going through the CBI's closure report, observed that in the face of facts starring at the face of investigating agency, the million dollar question that 'arises for consideration is whether it is a case of mere negligence or a case of deliberate omission on the part of the successive state directors of KVIC, Jammu. This mystery needs to be unravelled by the investigating officer by conducting an in-depth probe into the matter. It is thus clear that investigating officer has failed to investigate all the aspects of the case. The investigation is perfunctory and half- hearted in nature'.
"It is a settled law that a magistrate of a special court is not obliged to concur with the IO's investigation in a case where it feels that the investigation has not been conducted fully and properly," he said.
"As already stated, this court, in the given facts, is not satisfied with the investigation that has been conducted in the matter," the judge said and directed CBI to conduct further investigation into the case on the aspects and in the manner as indicated herein before.
Further investigation of the case should be completed within three months from today, he ordered.(JNF)
