HC accepts GDA CEO's apology for allowing repairs of hotels

Srinagar, Oct 28: Observing that laws have to be implemented without any deviation and breach, state high court has accepted the apology of CEO of Gulmarg Development Authority (GDA) for issuing permissions for repairs and renovations of hotels.
The high court has already stayed all permissions for repairs and renovations of hotels at Gulmarg. The CEO, who was present in the court, filed compliance report in terms of the October 18, 2016 court order and stated that he had issued permissions to hoteliers in good faith and pursuant to recommendations made in the report of court commissioners.
He also stated that he was under his bonafide belief that the September 22, 2016 court order had authorised him to issue such orders and that matter needed not to be place before BOCA.
He said all these permissions had been kept on hold and the position, existing as on October 5, 2016 was maintained. The carriage of material was also not allowed, he said.
He said in future, he would remain alive to the importance of his job, duties and responsibilities and would perform his duties strictly in accordance with the court orders as well as rules and regulations. He tendered apology for issuing the permissions, which, as already stated have been stayed by the court.
"It has been stated number of time earlier, in these proceedings, that Gulmarg is a world famous tourist destination. It becomes the duty of everybody to protect its ecology and environment. The laws have to be implemented without any deviation and breach," a division bench of Justice M H Attar and Justice A M Magrey said.
"In view of the explanation given by the CEO, the apology tendered by him is accepted. He undertakes to revoke all these permissions, for which liberty is given to him," the court said and directed him to proceed in the matter strictly in accordance with law and court orders.
"He will also place the entire issue before the competent authority, who shall pass orders in accordance with law," the court said.
The advocate general submitted that in a criminal case, which was pending on the files of Sessions Judge, Baramulla, an order had been passed, where under the chief secretary was asked as to what decision he had taken in the matter.
"Registry to call for the record from the court. It is made clear that the matter pertains to vesting of ownerships rights on some persons in respect of the properties situated at Gulmarg. The record of the case be tagged along with the case on next date of hearing," the court said and posted the PIL for further consideration in the week commencing from November 28 next.
The PIL was filed in 2012, seeking directions to save Gulmarg and Tangmarg from encroachments and pollution.
