GAD reconstitutes Complaint Committee
Sexual Harassment at Workplaces

jammu, Oct 28: A day before winding up its business in the summer capital the General Administration Department announced reconstitution of the complaint committee under Sexual Harassment of Women at Workplace Act 2013, thanks to concern shown by the Chief Minister Mehbooba Mufti time and again towards safety of women employees in Civil Secretariat.
Even as the Complaint committee was constituted earlier soon after this Act came into being during the previous coalition government, it could not deliver effectively for a number of reasons nor could the aggrieved women approach and access the committee directly as an effective mechanism for lodging complaints eluded. A proper mechanism and process of dealing or handling with the complaints was not in place nor has it come to fore as to how many complaints have been registered or settled, making its functionality redundant.
However, since the present government led by a woman Chief Minister has laid emphasis on safety of women staff at all levels, re constitution of the Complaint committee has assumed priority for the administration which gave it a final shape two days back by setting up a five member panel of women members besides chairperson.
The order to this effect issued on October 26 stated that in supersession of all previous orders on the subject and in pursuance of Section 4(1) of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, sanction has been accorded to the reconstitution of the Complaint Committee to register and enquire into and dispose of the complaints of sexual harassment against women employees of the Civil Secretariat.
The order further stated that its report on each complaint received by it regarding sexual harassment against women employees of the Secretariat for consideration of the Government. It further made it imperative for the committees to formulate quarterly/annual reports about the total number of complaints received, enquired by and action taken on the same.
The reconstituted committee which has mostly KAS officers on board comprises Dilshad Khan, Secretary to the Government, Department of Culture as Chairperson, Nitu Gupta, Special Secretary to the Government, Higher Education Department as member, Nuzhat Shah, Section Officer,Industries & Commerce Department-member. Besides there is provision of representative of an NGO to be nominated by the Social Welfare Department, any other person co-opted by the Chairperson.
The GAD in this order has also asked all the Administrative Secretaries to constitute similar committees in their respective departments at the State/Divisional and District levels.
The order further states that these committees shall address all complaints of sexual harassment and submit action taken reports to the Government with specific recommendations, in accordance with rules, on quarterly or annually basis. While the GAD has made it clear that the constitution or composition of the committees shall be reviewed periodically by it, it remains to be seen whether it sticks.
