Court strictures on Ramban police for unfair probe in 10 workers' death

Jammu, Dec 8: Chief Judicial Magistrate (CJM), Ramban, Yahaya Firdoos Ahangar has expressed displeasure over the manner in which special investigation team (SIT) of police has conducted probe into the Dalwas fire incident that had claimed the lives of 10 labourers.
The SIT is headed by additional SP, Ramban. The labourers were celebrating New Year on the night of December 31, 2015 when fire had erupted at Dalwas, the base camp of Chenani-Nashri tunnel. A case in this connection was registered at Chanderkot police station.
Considering the bail applications moved by some labourers, who were apprehended by SIT, the CJM, after hearing the counsel for the accused and CPO along with the case IO, expressed deep concern over shielding of the real accused and delay in completion of the investigation.
The court observed with concern that when the case diaries were again called today and perused, this court did not find any concrete steps taken by the IO after passing of the December 3, 2016 order and the IO had maintained status quo in the investigation.
"The case diaries reveal that IO has received all the opinions from the forensic laboratory and has also recorded the statement of witnesses under section 161 of CrPC but the court could not understand as to why there is delay for presenting the final chargesheet," the judge said.
Lambasting SIT over delay in the matter, the CJM said, "On the previous hearing, the court had observed that the occurrence had taken place almost an year back, ie on January 1, 2016 and the victims are yet to get justice and the defaulters are yet to be booked. The court will not hesitate in making the observation that all this has happened only because of the snail's speed of SIT."
"It is hoped that SIT will produce the chargesheet in near future as the court does not find anything to be investigated further and the same has also been admitted by the IO except that the statement of one injured witness is yet to be recorded," the court said.
After the IO and the CPO stated in the open court that accused were no more required for any kind of interrogation, the court had accordingly made the interim bail granted to them on December 3, 2016 absolute. The CJM, however, did not close the proceedings of the bail application and kept the matter alive for monitoring the investigation.
The CJM directed that CPO would produce the case diaries along with IO and SIT chairman on next date of hearing in order to apprise the court about the latest stage of investigation and fixed the matter on December 29, 2016.
