DB quashes KAS mains, directs PSC to hold exams afresh

Jammu, Mar 13: In a LPA filed by Public Service Commission against the judgment of writ Court, a Division Bench of the State High Court Comprising Justice Janak Raj Kotwal and Justice Sanjeev Kumar today directed the cancellation of the main examination at whatever stage it is as on date and directed the appellant to hold the main examination afresh.
In the 33 pages judgment written by Justice Sanjeev Kumar, the Division Bench observed that Since the examination in question has been delayed due to litigation, we hope and trust that the appellant would take immediate steps to hold the main examination and complete the whole process culminating into declaration of result without any further wastage of time.
DB observed that keeping these 2365 candidates out of the process of selection would be doing grave injustice to such candidates and would generate unnecessary litigation. This Court had been told that the appellant have proceeded with the main examination and 429 candidates, who had been earlier shortlisted in the first result of the preliminary examination but had gone out of zone upon re-evaluation, alone have been allowed to participate in addition to the candidates who have made it to the main examination on the basis of their merit determined in the process of re-evaluation.
Division Bench observed that having been left with no option and directed the cancellation of the main examination at whatever stage it is as on date and also directed the appellant to hold the main examination afresh. With these observations, Division Bench disposed off the petition.
