Rapist ties nuptial knot with victim, acquitted

Bhaderwah, May 19: Principal Sessions Judge Bhaderwah M.K. Sharma, acquitted one Fareed Ahmed S/O Ghulam Rasool R/O Drondi Kellar, Tehsil Bhalla, who was facing charge of rape with the allegations that he promised to marry the victim and induced the victim to cohabit with him. The victim submitted herself to sexual intercourse on the assurance of the accused to marry her but when the accused backtracked from the promise, the prosecutrix moved the police machinery and got the accused booked for the commission of offence of rape.
Interestingly, during the course of trial, the accused submitted before the court that he never backtracked from the promise and is ready to marry the prosecutrix. Accordingly, the accused was granted interim bail and during the period of interim bail the accused married the prosecutrix. On receipt of sufficient evidence regarding marriage of the accused with the prosecutrix, the court held that the ingredients of Section 375 RPC punishable under section 376 RPC are not made out, as such the accused is acquitted.
