Accused involved in forgery case, convicted

SRINAGAR, Aug 2: The Court of 2nd Additional Session Judge Srinagar on 01/08/2018 convicted one Tundup Guylson S/O Sonam Stabon R/O Tikhsa Leh presently clerk in the office of ARTO Leh in case FIR NO. 28/2000 U/S 420,468,467,109 and 120-B RPC P/S Crime Branch Kashmir Srinagar and awarded him with simple imprisonment of 10 years and a fine of Rs. 20,000/= for offence U/S 467 RPC, and 05 years simple imprisonment for offence U/S 468 with fine of Rs. 10,000/=. Both the imprisonments are to run concurrently.
Brief facts of the Case are that during the course of investigation in Case FIR NO. 99/1998 by P/S Crime Branch Kashmir it revealed that two Cars viz. Maruti and one Santro Car having similar registration Numbers i'e. JK03-4020 were intercepted and on verification it was found that the registration was actually belongs to one scooter and that the documents in respect of the said two cars were fraudulently prepared to support the title of the said cars.
After the registration of Case FIR No. 28/2000 the investigation was started wherein it surfaced that the scooter bearing No. JK03-4020 was registered in the name of one Showkat Ahmad R/O Anantnag. The registration files pertaining to the said Maruti Car/Santro could not however be located from the ARTO office Anantnag. Fabricated records in said office regarding the fake title of the two cars was prepared by the convictee accused No. (2) namely TundupGuylson in convince with the another two accused persons namely (1) Irshad Ahmad Khan S/O Mohammad Shafi R/O Sarai BalaSgr. and (3) Mehfooz Ahmad @ Sajad Khakhi (dead) S/O GhNabo R/O Ghat Kothibagh Sgr.
It revealed that accused no. (3) has provided fake and forged registration certificate of the Santro car to the person who purchased the vehicle and registration certificate was prepared by the accused No. (2) the convict. The Santro car was also involved in the theft case of Case FIR No. 79/2000 P/S Moti Nager West Delhi. The hand writing of accused No (2) has been confirmed by the FSL expert on the forged documents.
The accused No (3) has died, during the course of investigation. Challan was submitted against accused No(1) and (2) on 29-11-2005 before the Hon'ble Court. During the trial, charges were framed against accused (1) & (2) under the relevant sections out of 24 prosecution witnesses 12 witnesses were examined and finally on 01-08-2018 the Hon'ble Court has convicted accused No. (2) namely TundupGuylson S/O Sonam Stabon R/O Tikhsa Leh U/S 467,468 RPC while as accused No.(1) was acquitted of the charges leveled against him.
