High Court stays transfer order issued by CAHO Kishtwar

Srinagar, Aug 11: The Jammu and Kashmir High Court has stayed the transfer order issued by the I/C Chief Animal Husbandry Officer (CAHO) Kishtwar.
As per the details available with "Early Times", the petitioner Liyaqat Hussain son of Ghulam Hussain Resident of Sangrabata Kishtwar, a senior Poultry Assistant stated that the post is a divisional carder and he was simply transferred on the verbal directions of the I/C CAHO to Poultry hatchery with the view to revive the poultry hatchery activities.
He further stated that CAHO has no competence or jurisdiction to issue the impugned order, although the same purports to be an order issued on the verbal directions of the DDC.
AAG Aseem Sawhney, AAG and Amit Gupta Dy. AG appeared on behalf of the government and sought two week time to file the objections and list the case again on 31-08-2018.
"In the mean team, subjected to objections and till next date of hearing, the operation of the order impunged dated 28-07-2018 shall remain stayed. However the pendency of the writ petition shall however not prevent the competent authority to issue appropriate orders of transfer in regard to the petitioner" read the court order. The court also issued the notice to Commissioner Secretary to Government Animal and Sheep Husbandry, Director Animal Husbandry Jammu & CAHO Kishtwar.
Meanwhile despite court order and stay, the I/C CAHO Kishtwar without his jurisdiction issued fresh direction to the petitioner Liyaqat Hussain (SPA) Chatroo vide order No. CAHO/K/Estt/1327-29 Dated 11-08-2018 directing him to report and join the new place of posting while referring to order No. CAHO/K/Estt/1174-77 Dated 28-07-2018 which was already stayed by the HC Court.
Reacting to the fresh order, the counsel of the petitioner said that they will put the fresh order before the court on next date of hearing and termed it as a contempt of court by the I/C CAHO Kishtwar. The `controversial' officer is also facing the charges of harassment from the veterinary doctors for which the government has already constituted an inquiry committee to probe the allegations.
