Police, Revenue officials fail to act against powerful land grabbers
Despite several communications administration sleeps over the issue

Jammu, Feb 21: Police and Revenue officials have failed to take action against the alleged land grabber despite scores of written communications sent by the Custodian Department and locals over alleged encroachment on the land owned by the department.
Deputy Custodian Evacuee Department, District Rajouri on 11-02-2019 in a communication to the SHO Sunderbani requested him to lodge FIR against the land grabbers but till date no FIR has been registered. "Kindly refer to the Field Inspector Evacuee Property Rajouri's letter No. DFUEP/11/2019 dated 05-02-2019 regarding the subject cited above. In this connection I request that copy of FIR may kindly be furnished to this office for its onwards submission to the higher authorities for accord of necessary sanction for prosecution of case under section 353 RPC against the delinquents namely Tam Chand s/o Hari Ram his sons namely Balwinder Singh and Kuldeep Raj all residents Ainpur Bhawal, Tehsil Sunderbani who have caused obstacle in implementation of court order dated 31-12-2018 passed by the Custodian Evacuee Property Jammu by way of placing Kali Devi W/o Tara Chand and Ratna Devi W/o Kuldeep Raj in front of JCB Machine which was hired by the Depth for removing the encroachment on spot," reads the communication of the Deputy Custodian Evacuee Property District Rajouri.
You are therefore, requested to kindly furnish the copy of FIR at an earliest so that nobody in future can dare to violate the rules and regulations of the department, further reads the communication.
It is pertinent to mention here that in 2016, Tara Chand had girdawri on 10 kanals of land under khasra number 355 but in 2018 Revenue Department registered 5 kanal extra land in favour of Tara Chand illegally following which the concerned Sarpanch made a panchaytnama and asked the Tehsildar Sunderbani to quash illegal 5 kanal girdwari of Tara Chand on Khasra number 355 but department has failed to take any action till date.
In 2018 they started construction to two more shops in front of Panchayat Ghar Ainpur and the material soil and stone was dumped opposite side of panchayati road.
Deputy Custodian Rajouri Mohammad Aijaz visited the on the spot and stopped the work and send an application dated 07-08-2018 number DFI/R/2018 under section 18 Evacuee Property Act 2006 against Tara Chand and his son Kuldeep Raj but surprisingly on 30-08-2018 they again started work and 31-08-2018 Deputy Custodian again came on the spot and seized all equipments and reported the matter to Custodian General Jammu & Kashmir
Deputy Custodian Rajouri took up the matter with concerned Station House Officer, Police Station Sunderbani for registration of case against the accused under section 18 of the J&K State Evacuee's (Administration of Property) Act vide his letter no 150-54/DC/EP/R dated 14-08-2018 but police have failed to take action against the said land grabber for unknown reasons.
Meanwhile, Custodian General J&K-Farooq Ahmad Shah also wrote to the Deputy Commissioner Rajouri seeking action against the said land grabbers. "It has been reported by the Deputy Custodian Rajouri that evacuee property land covered under Kh No. 355 situated at village Ainpur Tehsit Sunderbani District Rajouri has been encroached upon by way of dumping of 6 tippers of soil besides damaging the fencing of the said evacuee land by one Kuldeep Raj s/o Tara Chanel of village Ainpur Tebsil Sunderbani District Rajouri without any orders from the competent authority", reads the communication of Custodian General to Deputy Commissioner Rajouri vide no CG(EP) 2287-87 dated 31-08-2018.
The Deputy Custodian Rajouri has taken up the matter with concerned station House Officer, Police Station Sunderbani for registration of case against the said delinquent under section 18 of the J&K State Evacuee's (Administr-ation of Property) Act vide to his letter no 150-54/DC/EP/R dated 14-08-2018 but no action seems to be taken by the said police authorities till date, further reads the communique.
The Custodian General in his communication requested the Deputy Commissioner Rajouri to further take up the matter with the police authorities for registration of case but still the FIR was not registered.
