Court rejects bail of narco smuggler

JAMMU, Feb 23: CJM Samba today rejected bail application of a narco smuggler booked under NDPS Act.
CJM Ajay Kumar Gupta rejected the bail plea of Suraj Paul, son of Balwant Raj of Koulpur, tehsil Ramgarh, district Samba allegedly involved in NDPS Case.
CJM after hearing Senior PO Anil Saini for the State whereas Adv Sukhwinder Singh for the applicant observed in the police report as well as in the objections filed by Sr PO that the 275 number of Parvon Spas plus capsules weighing 630 gm each thereby the total weight of the capsules fall within the category of intermediate quantity and this court lacks jurisdiction to entertain the present bail application.
Court further observed that this is not the stage to look into the merits of the case and further apparently the seized capsules total numbering 275 comes within the preview of intermediate quantity. As at this stage it is not to be decided the weight of the whole quantity of the capsules or the weight of the drugs contained in each capsule seized and the fact that they comes within the preview of intermediate quantity. Thus, this court lacks jurisdiction because the same is to be tried by the Special Court. In the lights of the facts mentioned here-in-above, the present bail application is rejected. Ordered accordingly. (JNF)
