SIC directs PSC to provide copies of answer scripts

Jammu, Feb 23: State Information Commission (SIC) has directed the J&K Public Service Commission (PSC) to provide copies of answer scripts of shortlisted candidates for the post of lecturer +2 (political science) to an aggrieved information seeker under J&K Right to Information Act (RTI).
The sought information was denied earlier by the PIO of JKPSC Jammu citing it was a 3rd party information.
Details available with Early Times reveal that one Priya Kant Sharma an aggrieved candidate filed an RTI application with the PIO, J&K Public Service Commission on 27.06.2018, seeking answer key of the examination held for the post of Lecturer Political Science and photocopies of OMR sheet / answer sheet of those candidates who got shortlisted for interview in Open Category after the declaration of result of written examination conducted on 01.01.2017.
The PIO, JKPSC vide his order dated 14.08.2018 informed the information seeker that the information sought cannot be provided as per the decision of the Commission and the answer scripts duly evaluated shall not be subject to inspection by the candidates or a third party nor copies thereof to be made available. Aggrieved by the order of the PIO, the information seeker filed first appeal with the JKPSC on 31.08.2018. As the first appeal was not disposed of by the First Appellate Authority (FAA). The appellant Priya Kant Sharma filed 2nd appeal before State Information Commission (SIC) on 06.11.2018.
The appeal came up for hearing before the Commission on 6th February, 2019. The representative of the appellant as well as the PIO, JKPSC were present during the hearing. The PIO, JKPSC submitted that he has furnished the answer key and OMR sheet of the appellant to him. The representative of the appellant acknowledged the receipt of answer key and OMR sheet. However, he submitted that the PIO has not furnished the answer scripts of other participating candidates. The PIO, JKPSC informed the Commission that the process under section 11 of the J&K RTI Act, 2009 has been undertaken and the views of the third parties have been sought, as regards disclosure of their answer scripts.
The SIC observed on 6th Feb 2019:
" The appeal is, therefore, disposed of with a direction to the PIO to furnish the answer scripts of such other candidates to the appellant, who express their willingness to the disclosure of their answer scripts. In case, some or all the third party selected candidates object to the disclosure of their answer scripts, the PIO shall consider whether there exist any public interest in the disclosure of protected personal information of third parties and pass appropriate orders for disclosure or refusal to disclose such information to the appellant. Conclusion of the third party proceedings shall be made known to the appellant within a period 10 days from the receipt of this order."
