SIC issues notice to DC Kupwara

Kupwara, Mar 3: State Information Commission (SIC) has issued notice to Deputy Commissioner (District Magistrate) Kupwara to ensure protection of a Kashmiri Pandit (KP) migrant land that is allegedly under the occupation of Border Roads Organization (BRO) and some locals. The owner of the land through his counsel had issued notice to the DC and SSP Kupwara regarding the matter. When no action was taken aggrieved filed an RTI application to know the action taken report.
Details available with Early Times reveal that an RTI application was filed by one . Ramesh Kumar Bhat R/O Patoli Brahama Jammu actually hailing from Kupwara on 20.07.2018 seeking information from PIO in the office of Deputy Commissioner, Kupwara .
The subsequent appeal came up for hearing before the Commission on 19.02.2018 wherein tehsildar Kralpora submitted that as per the detailed report obtained from the field agency, the land under Survey Nos 18, 48, 92, 110, 111, 116, 138, 146, 148, 149 and 150 is recorded in the name of the appellant Ramesh Kumar Bhat S/O Bansi Lal Bhat . However, the said land is at present under cultivation of Javaid Ahmad S/o Rasool Mir Gul Chopan S/o Sultan Chopan. In addition to this some, portion of the land is under the possession of Beacon Organization. Tehsildar Kralpora has also reported that the land in question has been put under superdnama of Lumberdar and Chowkidar of the village and the cultivators/encroachers have been directed to produce documents authorizing their possession/cultivation of the migrant land. It has also been informed that the matter has been taken with Beacon/ BRO authorities as to how they have occupied migrant land and established Hot Mix Plant.
SIC while disposing off the RTI appeal observed
"Since the Tehsildar Kralpora has in his report submitted to ACR (Kupwara) informed that the land in question is being cultivated by Javaid Ahmad Mir and Gul Chopan and that they have been directed to produce documents authorizing possession and cultivation of the said land, the Dy. Commissioner, Kupwara in his capacity of the custodian of the migrant property within his area of jurisdiction, shall take necessary steps for protection and preservation of the immovable property of the appellant including the part of land under the possession of Beacon Authorities and inform the appellant about the steps taken in response to the Legal Notice served by the appellant through his counsel. The appeal is accordingly disposed of with an advisory to District Magistrate, Kupwara to take all necessary steps as are required for protection and preservation of the migrant property in terms of the provisions of the J&K Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997.
