Srinagar, Mar 6: State Information Commi-ssion (SIC) has directed the Jammu & Kashmir Projects Construction Corporation (JKPCC) to reveal details about Paper Machie work undertaken at Shrine of Dastgeer sahib in Khanyar Srinagar. The information was denied earlier as the contractor had allegedly misled JKPCC by telling them that the Labour Court had forbidden to disclose the details about the said work.
Details available with Early Times reveal that one Mohammad Shafiq Mir a resident of Baghwan Pora Srinagar filed an application under RTI Act dated 28.08.2018 before the Public Information Officer (PIO) JKPCC. Applicant sought information relating to Paper Mashie works executed at the Shrine of Peer Dastigeer Sahib Khanyar especially vis a vis details of payments made to the contractor and copy of M Books relating to the said work.
The PIO vide his communication dated 29.10.2018 informed Mir that Contractor namely Liyakat Ali Khan, who executed the work at the Shrine vide letter dated 22.11.2017. has objected to the disclosure of information and has served a notice as according to him matter is sub-judice before the court of Assistant Labour Comm-issioner, Srinagar.
During the hearing the PIO pleaded that since the contractor gave a notice to the JKPCC not to share the information, the information sought by the appellant was not provided to him.
While disposing the appeal State Information Commission (SIC) observed, "While going through the notice served by the contactor in this case, and also the contents of the RTI application filed by the appellant, the Commission is of the view that the information sought by the appellant does not involve any 3rd party information.
Merely the case being subjudice before the court of Assistant Labour Commissioner does not preclude or restrain the PIO from providing the information to the appellant as sought by him.
The appeal is disposed of with a direction to the PIO to provide the requisite information to the appellant in the form it is available with the Public Authority and in the manner it is being maintained in the Public Authority within a period of one week from the date of receipt of this order "
