ICPS's Mission Dir flouts Juvenile Justice Act with impunity | | |
Early Times Report srinagar, Apr 29: Despite tall claims by the government that Integrated Child Protection Scheme (ICPS) would be implemented in a mission mode in the state for the protection of vulnerable children, the Mission Director ICPS has been flouting the Juvenile Justice Act with impunity. Sources told Early Times that besides attaching the members of district level Child Welfare Committees (CWCs), Juvenile Justices Boards (JJBs) and other staff of district child protection units (DCPUs), the Director has been flouting the laid down norms brazenly. "Nearly a dozen members of CWCs, JJBs and DCPUs from various districts have been attached with the Director's office in Srinagar since last one year which is clear violation of the Jammu and Kashmir Juvenile Justice Act, 2013," they said. "The Director is functioning like a dictator and has attached one member of JJB Srinagar to Mission Directorate office. The said member instead of attending her duties is harassing other employees in the ICPS flaunting her close proximity with the Director," they alleged. On February 22 this year the CWC Srinagar in a written complaint against this JJB member, a copy of which lies with Early Times, had complained to the chairperson of screening-cum-oversight-committee (SOSC) of the ICPS, then headed by Justice (retd) Hasnain Masoodi that the said member was interfering in their work. "With humble submission and reverence, the CWC Srinagar along with SDPU Srinagar would like to state that JJB member, who is acting as nodal officer, JJB Srinagar namely Khair-un-Nisa is unnecessarily interfering in the affairs of CWC and DCPU, which is regrettable," the complaint reads. According to J&K JJ Act 2013, the Mission Director had to put up the complaint before the chairperson and members of the SOSC at the earliest. "All complaints against the chairperson/member of the JJB as the case may be shall be addressed to the Member-Secretary of the SOSC of forwarded to the Member-Secretary by the Government. The SOSC shall then issue a show cause notice to the person against whom complaint is received," the Act says. "Where the SOSC doesn't receive a satisfactory reply to the show cause notice issued, it shall commence an inquiry into the complaint. The inquiry has to be completed within two months, a report has to prepared and suitable action has to be recommended," it adds. However, some member of the CWC and DCPU Srinagar said the concerned authorities failed to initiate any action against the said member due to her close proximity with the Director. "It is unfortunate that the Director instead of taking care of child protection, is concerned about taking care of a few blue-eyed officials. He (Director) is behaving like a dictator and the said JJB member is not only interfering in the work of others but also harassing them," he said. While appealing to the Chief Secretary, Chief Justice of High Court and Secretary Social Welfare to look into the mess created by the Mission Director ICPS, they said, "We also appeal to the Governor Satya Pal Malik to personally intervene into the issue. The officials of the districts, who have been attached with the Mission Directorate must be sent back to their duties." |
