Have uniform policy for terminated NHM employees, staff nurses: HC to Govt | | | Asif Iqbal Naik
Early Times Report Jammu, Apr 30: In a major relief to National Health Mission (NHM) employees, the J&K High Court has asked the state government to have a uniform policy to deal with NHM employees who have been terminated by their respective district societies for remaining absent in connection with the strike. The directions were issued by Justice Sanjeev Kumar against the order impugned dated 16.02-2019 passed by Deputy Commissioner Kishtwar who is chairman District Health Society whereby the services of NHM employees of block Dachhan were terminated for unauthorized absence due to strike. The 29 petitioners had approached the High Court through Advocate Faheem Shokat Butt through the medium of SWP No. 850/2019. Advocate Butt argued that the termination order had been issued without complying with the procedures established under law, and moreover in some other districts, the termination orders of NHM employees were revoked. Thus there is no uniform policy and the petitioners cannot be discriminated with, Butt argued. After hearing the counsel for petitioners and Advocate H A Siddiqui, Sr. A.A.G appearing for the State, the High Court while issuing notice to the respondents directed the State to file objections indicating clearly as to whether the respondents have any uniform policy to deal with NHM employees who came to be terminated by their respective district societies for remaining unauthorized absent in connection with the strike. Taking note that in district Leh, Samba and Kupwara, the termination orders were already recalled, as such the State was directed that this aspect needs to be clarified and dealt with by the respondents in their reply and Government has been directed to come up with the stand on the issue and fixed the matter for 13-05.2019. In another matter bearing SWP No. 872/2019 filed by Archana Devi Jr. Staff Nurse of Block Dachhan through her Advocate Butt, the High Court, vide its order dated 30.04.2019 stayed the operation of termination order dated 16-02-2019 issued by Deputy Commissioner Kishtwar in capacity as Chairman District Health Society. The said order was passed after Advocate Butt argued that the petitioner was transferred to Jammu and was performing her duties at government hospital Sarwal, but the Deputy Commissioner unmindful of the fact passed termination order. Among the respondents are Commissioner Secretary Health, Mission Director NHM, DC Kishtwar, CMO Kishtwar and BMO Dachhan. |
