Situation demands Malik Sahib! Kindly act a politically always

Being the Constitutional Head and the representative of the President of India that too in the sensitive state of the Union of India, normally, Satya Pal Malik should not have made any political statement. By referring about the involvement of Rajiv Gandhi, he has lowered the dignity and the status of the Institution of the Governor. As far as possible the Governor should avoid such like eventualities. It is very unfortunate to notice that the Governor of Jammu and Kashmir Satya Pal Malik has made a statement on Thursday that the former Prime Minister of India Rajiv Gandhi was involved in the Bofors scam. While addressing at an official event of the Inauguration of the Traffic Grade Separater at TRC Srinagar on May9, he made a reference about Rajiv Gandhi. In fact, indirectly he has given the hint towards his soft corner for the present rulers of the NDA at the Center. Speaking so, he cannot deny it as the event was being covered by the print and electronic media journalists and the various reporters. This was not expected from him as he is the former seasoned and experienced politician of the country. There are also certain occasions when the Governor of the state has done so over which the political leaders of the state have condemned him and in turn, they advised him to remain within the ambit of the Indian Constitution as his prestigious post is apolitical one. Against his present political statement, many a politicians in the country have sharply reacted and criticized him on this score. It seems that Satya Pal Malik has forgotten the facts that it was only Rajiv Gandhi who purchased the Bofors guns for the Indian Army which gave the befitting reply to Pakistan in Kargil war because of which Pakistan had to vacate the Indian territory and had invited thousands of killings of its military men, Not only this, it was Rajiv Gandhi who brought the Computer and Information Technology to this country resulting which the country is making the sharp progress in the fields of development of the nation, The Indian experts in this field have made the dent and enjoy the good reputation in the World.
Sanjay Nirupam has condemned the statement of the Governor of J&K Satya Pal Malik on May,9 with the strong words wherein he made the statement on at Srinagar in which talked about the involvement of the former Prime Minister of India Rajiv Gandhi. Nirupam termed the Governors as the "CHAMCHAAS" of the Central Government led by the Prime Minister Narender Modi.
Similar statements have come from the leader of the opposition in the Rajya Sabha Ghulam Nabi Azad, President of INC J&K G.A. Mir, Saifudin Soz and others who too condemned the Malik's remarks about the former Prime Minister of India Rajiv Gandhi.
President of INC J&K G.A. Mir reacted sharply while condemning the Governor stated that he is misusing his position as the state Governor in order to please his bosses in New Delhi by joining the vilification campaign against Rajiv Gandhi who martyred for the motherland. Subsequently, Jammu witnessed the massive protests made by the Congressmen of the INC led by the former Minister Raman Bhalla and former MLAs. All these leaders condemned the remarks made by the present Governor about Rajiv Gandhi and they made it clear that the clean chit was given to the former Prime Minister Rajiv Gandhi in the Judicial process in this regard. Theyalleged that the the Governor Satya Pal Malik has joined his hands with the BJP wagon in degrading Rajiv Gandhi that too during these days of Lok Sabha elections in the country and they smell about some conspiracy between the Governor and the central leadership of the BJP in power. None from the BJP brigade has reacted so far but kept mum on this score but on the contrary they were all out making the major issues of corruption happened during the Congress and UPA's Rules, during the Lok Sabha elections campaign in the country which ended on May, 17. Making of the statement by Satya Pal Malik by at this juncture has lowered the prestige and the image of the constitutional post of the Governor that too in the sensitive state like J&K in the Indian Union. As far as I am concerned being the Law graduate and son of the soil, the Institution of the Governor's office as under:- The Governor is the head of a state. He is the Chief Executive in the state. He enjoys the same position in the state as the President enjoys in the Centre. However, in a way his position is slightly better. Whereas the President as the nominal Executive of the Union can rarely use any discretion in the exercise of his powers, the Constitution grants some discretionary powers to the Governor. The Constitution of India lays down for the office the Governor of each State." However, one person can also function as a Governor of two or more states. The President of India appoints the Governor of each state and while doing so he acts upon the advice of the Prime Minister. In the Constitution of India, the Executive, Judicial, Legislative, Financial, Discretionary powers besides describing of the essentials and the qualifications and the periodicity for the appointment as the Governor of the state, have been defined specifically within the ambit of which the Governor of the state has to function while discharging his duties as the Governor. A clear cut embargo is there that he has been restricted in making the political statements. It is very much relevant to mention here that two important practices adopted in the past regarding the Appointment of a Governor:-The first practice is that the person being appointed as the Governor is mostly not a resident of the state for which he is appointed andSecondly, before appointing a Governor, the Union Governments consults the concerned State Government particularly the Chief Minister of that State. It is now a respected Rule. Though his background is of a political leader but here in J&K at the moment, he is on the prestigious and the Constitutional post. He is very much under obligation to discharge his position as the Governor of the sensitive state only. Unlike his predecessors in the past, Satya Pal Malik is doing well in maintaining the law and order in the state in close coordination with the Indian Army. Separatists and the Hurriayat Amalgamation leaders in the state have been reduced to the skeleton during his tenure as the Governor of the state effectively. His main priority should be the welfare of the poor masses of the state besides the elimination of the local and Pak terrorists in the valley. Satya Pal Malik should try his best to concentrate on the governance of the state effectively instead of entering into the unnecessary controversies.
It is very important to mention here that when Bhartiya Janta Party withdrew its support from the Coalition Government in J&K led by the former Chief Minister and PDP Chief Mehbooba Mufti last year on June 19, Sajad Gani Lone Chief of the People's Conference and a member of the Mufti's cabinet first staked the claim for forming the government in the support with the Bhartiya Janta Party Legislators followed the staking of claiming for the government by the NC, PDP and INC under the Chief Minister ship of Mehbooba Mufti once again which was turned by the present Governor of the state Satya Pal Malik who imposed the Governor's Rule in the state on June20 last year without having consulted the Central Government at that time. The present Governor of the state Satya Pal Malik is on record for having said the same in support of imposing the Governor's Rule in the state on the next day. The support of the NC and INC was considered as the height of opportunism in the state politics. Day and night National Conference and the Indian National Congress were fighting with each other in the past and at that time they get united immediately and requested the Governor for forming the Coalition Government of PDP and NC thereby putting the Governor of the state Satya Pal Malik in fix. Thank God Malik Sahib acted promptly without caring for the reaction from the Central Government led by the Prime Minister Narender Modi at that time. His decision on this score was welcomed by the people of the state and the country also. This political dramas made by Sajad Ghani Lone and PDP Chief Mehbooba Mufti also could not be matured due to the high wisdom of the present Governor Satya Pal Malik. But one thing is certainly appreciable that the Governor's administration presently is dealing with the Kashmir situation very firmly with the iron hands. The properties and the funds raised by the Separatists and the leaders of the Hurriayat Amalgamation are being seized, NIA has also tightened these leaders by initiating the various investigations after having filed the various FIRs in various Police Stations in the valley besides elimination of the Pak and local terrorists operating in the state with firm hands. Not only this, after arresting the leaders of the Separatists and the leaders of the Hurriayat Amalgamation, they are being shifted in the jails outside the state. This goes to the credit of the Governor. Also it is really appreciable that the Bipin Rawat Army Chief has been given the free hand to deal with the present ugly situation in the valley. With all doing this, it is expected that the bad situation in the valley would be curtailed soon.
Under the prevailing circumstances in the sensitive state of Jammu and Kashmir, the situation demands that the Governor of the state should apply the restraints over making the unnecessary controversial statements so as to avoid the ill designed and bad strategies from the antinational elements and the Kashmir centric leadership of the regional political parties of the state. Such like utterances from the Governor's side give the tonic to them for their flourishment in the state as also for winning the sympathies of the common masses who are generally the illiterates. Therefore, it becomes obligatory on the part of the Governor to remain as apolitical identity as far as possible till the popular government resumes power in the state.
