Bhukki smuggler's bail rejected

JAMMU, July 11 : Principal Sessions Judge Jammu Vinod Chatterji Koul rejected the bail application of one Kulwinder Singh, son of Balkar Singh of Kotla Bet Chourian, Tehsil Samarala, District Ludhiana (Punjab) from whose possession police recovered 210 kgs of Bhukki.
According to the police report that on 15.05.2019 at 1605 hours ASI Mohd Akram incharge P/S Bagh-e-Bahu along with other police personnel were on patrolling at Mohmaya area and had laid naka at Environment Park NHW and were checking the vehicles coming from Srinagar. During checking at about 3.30 PM, one truck bearing No: PB65K1613 was signaled to stop but the driver of the truck tried to fled and the truck in question was stopped. One more person was also sitting in the truck. On enquiry the driver disclosed his name as Dalbir Singh and the other persons disclosed his name as Kulvinder Singh. During checking of the truck, Bhukki was found in 210 bags weighing 210 Kg, wrapped in a polythene bag below the plywood.
Principal Sessions Judge Jammu Vinod Chatterji Koul after hearing both the sides observed that it is settled law that in non-bailable offences, the accused cannot claim bail as a matter of right. Moreover, while dealing with the bail matters the Court has to see whether the offence alleged against the accused is heinous in nature and severity of the punishment prescribed and other factors. Court has to strike the balance between individual interest of the accused person and interest of the society at large. With these observations Court rejected the bail application. --(JNF)
