Hr Sec school principal completed PG while on duty

kupwara, July 15: A Government Higher Secondary School Principal in Kupwara district has come under the scanner of State Information Commission (SIC). The commission has directed the Chief Education Officer (CEO) Kupwara to reveal details under Right to Information Act (RTI) to an information seeker whether the said principal had availed study leave or not in past when he had gone to Kanpur for undergoing Post Graduation (PG) in Chemistry subject.
Details available with Early Times reveal that an RTI application dated 17-10-2018 was filed by one Nazir Ahmad Payer a resident of Hyhama Kupwara with Public Information Officer (PIO)/Chief Education Officer, Kupwara seeking information pertaining to one Muhammad Ramzan Sofi, Principal, Govt. BHSS, Kalaroos. Information seeker sought certified copies of PG Marks sheet & PG Certificate. RTI applicant wanted to know whether the Principal has availed Study Leave/Permission for pursuing PG or not. If yes, the period for which the leave/permission was availed was also sought
As the PIO (CEO Kupwara) failed to respond to his RTI application dated 17- 10-2018, the appellant filed the First Appeal before the First Appellate Authority (FAA)/Directorate of School Education, Kashmir on 30-11-2018. However, the FAA also failed to dispose of the first appeal. The appellant accordingly filed this 2nd appeal before the State Information Commission (SIC).
While going through the information, it was found that though PG marks sheet of Muhammad Ramzan Sofi and photo copy of the service book had been provided to the appellant but no information has been provided to the appellant in respect of point No. 2 i.e. whether any study leave was sanctioned in favour of the Principal and whether he had obtained prior permission of the competent authority for undergoing higher studies while being in service ?
SIC during case hearing observed that copy of service book provided to the appellant revealed that no entry had been made in the said service book about study leave or prior permission of the competent authority granted in favour of Muhammad Ramzan Sofi. On the other hand, the service book shows that the said teacher was all along present on duty and drawing the salary.
While disposing off the appeal SIC in its orde said
"After hearing the parties and with their agreement, the appeal is disposed of with the direction to PIO/Chief Education Officer, Kupwara to furnish specific information to the appellant within a period of ten days from the date of receipt of this order whether Mr. Muhammad Ramzan Sofi had applied for study leave and sought prior permission for undergoing M. Sc. Course in Kanpur University and if so whether such study leave was granted in his favour. In case the PIO fails to furnish this information to the appellant within the period stipulated above, the appellant shall have the liberty to file a complaint against the PIO before the Commission under section 15 of the J&K Right to Information Act, 2009 "
