Article 370 scrapped which granted special status to Jammu Kashmir

One-month long suspense is over after the Union Cabinet decided to end Article 370, which grants special status to Jammu and Kashmir and decided in favour of bifurcation and not trifurcation of the state. It decided that Ladakh be given the status of union territory as promised by the BJP and leave Jammu and Kashmir as one state under the command of the centre. Since the Union Government was thinking of taking some firm stand which may irk people in Kashmir was the reason behind the Government curtailing the annual Amarnath yatra and calling upon tourists, including those from foreign lands to leave Kashmir. And since the Union Government led by the BJP was not sure about the reaction of the people it placed top leaders from the NC, PDP and CPIM and Sajjad Lone under house arrest because they had the potential of provoking people to stage protest rallies. And Article 35-A has been fiddled with the announcement that anybody living outside the state could buy land and other immovable property in Kashmir.
And the entire Monday passed without internet facilities and phone connection was snapped. And various parts of the state was placed under curfew restrictions after the entire state was placed under section 144. However the Congress, the PDP and the National Conference opposed the Government for changing the history of the state of Jammu and Kashmir. The Congress leader Ghulam Nabi Azad protested against the Union Governments decision calling it murder of constitutional provisions. The government has added in the Article 367 of the Constitution a clause 4 which makes four Reference to this Constitution or to the provisions thereof shall be construed as references to the Constitution or the provisions thereof as applied in relations to Jammu and Kashmir," it said. Under the decision the state will cease to have a separate flag and constitution.
The order said references to the person for the time being recognised by the president on the recommendation of the Legislative Assembly of the State as the Sadar-i-Riyasat of Jammu and Kashmir, acting on the advice of the Council of Ministers of the state for the time being in office, shall be construed as references to the Governor of Jammu and Kashmir. References to the Governor of Jammu and Kashmir shall be construed as including references to the Governor of Jammu and Kashmir acting on the advice of his Council of Ministers, it said. In proviso to clause (3) of Article 370 of this Constitution, the expression "Constituent Assembly of the State referred to in clause (2)" shall read "Legislative Assembly of the State", it said. The BJP had made a poll promise to scrap the Article and has long held the position that it was a hindrance to amalgamate the state into the mainstreams of constitutions. The PDP member of the Rajya Sabha was seen tearing his shirt as a protest against the centres decision.
