Court rejects bail of chemists for selling banned drugs

JAMMU, Sept 2: Additional Sessions Judge Jammu Tahir Khurshid Raina has rejected the bail application of Parveen Kumar @ Heera, a chemist shop owner for selling banned drugs without prescriptions who was booked by Police Station RS Pura in FIR NO 139/2019 u/s 8/21/22/29 NDPS Act.
While rejecting bail application, Additional Sessions Judge Tahir Khurshid Raina observed that argument of the counsel for the accused/applicant is that the Narcotic drugs which have been seized from the co-accused and for which accused has been charge sheeted along with him falls in intermediate category and therefore entitled for bail as the bail is not hit by the rigour of section 37 of NDPS Act. Upon this Court observed that as per the charge sheet not only he is found to have direct link with the co-accused from whom intermediate category of the contraband drugs have been recovered but he is used as pimp for supplying narcotic drug in the society especially to the younger generation. Moreover, the most serious part of charge sheet prominently relates to accused-applicant only who is the supplier of contraband drug in the area and as reported, just in one year span he has sold and supplied illegally more than 14000 narcotic drugs like Tramadol, Alprozolam, etc in the society which are quite huge, crosses the mark of commercial quantity under the NDPS Act.
Additional Sessions Judge Jammu Tahir Khurshid Raina further observed that once he failed to give details of selling these drugs, it obviously means that he has supplied them in the society to the younger generation as stand referred in the charge sheet and corroborated by the co-accused from whose possession Narcotic drugs have been recovered and stated to have been purchased from the applicant-accused.
Court further observed that it is infact ironical that a very pious human service occupation has been grossly misused for greed. Instead of acting as a source of panacea of ailments, he himself became the source of ailment in the society by pushing the younger generation into the dark clouds of dejection and despair.
With these observations Court is consciously convinced that accused-applicant does not deserve the concession of bail at this stage and rejected the bail application.
