DB asks Div Com Kashmir to monitor LAWDA, SMC's exercise on constructions | | | Early Times Report SRINAGAR, Nov 5: Justice Ali Mohammad Magrey directed Divisional Commissioner, Kashmir, to monitor the exercise undertaken by the J&K Lakes and Waterways Development Authority and Srinagar Municipal Corporation, for ensuring adherence to the permission issued for construction in tune with norms and laws governing the subject. Divisional Commissioner, Kashmir, shall seek report from both the authorities i.e. J&K Lakes and Waterways Development Authority and Srinagar Municipal Corporation, about deviation of construction of residential houses/commercial complexes and ensure stopping of such constructions. Divisional Commissioner, Kashmir, for the purpose of enforcement of law regarding adherence to building permissions, shall call meeting of all the concerned officers of J&K Lakes and Waterways Development Authority and Srinagar Municipal Corporation, for ensuring compliance of order passed by the Court by or before next date of hearing. Justice Ali Mohammad Magrey further directed Principal Secretary to Government, Housing & Urban Development Department, shall update the status of compliance of order passed by this Court on 15.10.2019 whereby Court directed Principal Secretary to Government Housing and Urban Development Department to submit the list of permissions granted in the whole city of Srinagar from the Authority, headed by Commissioner Secretary to Srinagar, Municipal Corporation as also the Chairman Lakes and Waterways Development Authority, initially for the last six months with the report of the concerned authorities about the adherence of the conditions of permission or its violation. Principal Secretary shall also order an enquiry into the subject of the permission so as to ascertain as to how the respondents have raised the construction by major violation of the permission. If on preliminary enquiry, the erring officers/officials are found prima facie involved, further action shall be taken against them in terms of rules and law. Justice Ali Mohammad Magrey further directed Commissioner/Secretary to Government, General Administration Department, has not submitted the status report regarding posting of honest, upright officers as members of Tribunal and directed that needful shall be done by or before next date of hearing. -JNF |
