For 16 years highest bidder fails to construct shop at Pulwama, government suffers huge loss
Director Local Bodies Kashmir’s latest directive also falls flat

SRINAGAR, Feb 9: For the past 16 years or so a resident of South Kashmir’s Pulwama district has failed to construct a shop allotted to him by the Municipal Committee Pulwama after his bid was found out to be highest one during the bidding process.
On May 10, 2004 then Administrator Municipal Committee, Pulwama allotted in favour of Mudasir Ahmed Malik resident of Dalipora, Pulwama a space of 130 square feet for the construction of a shop at old Jammu & Kashmir Bank Limited at Pulwama. The highest bidder had offered rate of Rs. 5 per square feet for the space mentioned in the bid notice.
“In pursuance to discussions held with Director Urban Local Bodies Kashmir on the issue, sanction is hereby accorded to the allotment of the said shop site measuring 10 X 13 feet in favour of highest bidder on the below mentioned terms and conditions,” reads the order issued by then Administrator Municipal Committee, Pulwama.
The terms and conditions as set out in the order included that the allottee shall be bound to raise construction of a single storey shop on his own expenses, the allottee shall not sublet the site/shop to any person or agency and the allottee shall pay advance rent of one year in the chest of Municipal Committee Pulwama.
The other conditions included that the construction would be raised in accordance with the plan approved by engineering staff of the committee, the structure shall not be in violation of Ribbon Development Act or Municipal Rules, the property shall vest with the Municipal Committee Pulwama, the allottee shall enjoy the tenancy rights only and the allottee shall have to execute a normal rent deed with the Committee concerned.
For years together the allottee did not raise any construction and the shop did not come up despite lapse of so many years. In 2017 it was decided that construction of shops with accommodation for Driver’s Union at Old Bus Stand Pulwama will now be constructed at New Bus Stand Drussu Pulwama as per arguments of general public that since the Bus Adda is being shifted to Drussu Pulwama it will not be feasible to construct the union office at Old Bus Adda.
It was also decided that the ground floor of the building would be allotted to Mudasir Ahmed Malik since Mudasir would borne the construction cost of the entire building. But this order too was not implemented with the drivers union approaching the office of Director Local Bodies Kashmir with the plea that they are facing problems in the absence of the union office.
On January 24, 2020 Director Urban Local Bodies Kashmir issued an order according to which a committee of five members was formed to conduct smooth auction of three shops at New Bus Stand Pulwama after observance of codal formalities as required under rules and regulations.
The committee comprised of Additional District Development Commissioner Pulwama, Executive Engineer Urban Local Bodies Kashmir, Assistant Accounts Officer, Urban Local Bodies Kashmir, Executive Officer Municipal Committee Budgam and Executive Officer Municipal Committee Pulwama. The committee is yet to respond to the order and as such no auction whatsoever has taken place.
