Jammu, Mar 20: Division Bench of the J&K High Court comprising of the Chief Justice Gita Mittal and Justice Rajesh Bindal conducted the Court simultaneously at Jammu as well as Srinagar for hearing the Public Interest Litigation regarding Covid 19 (corona virus).
Though the Bench held proceedings, physically at Jammu but virtually through video conference at Srinagar where the proceedings in the crucial two PILs regarding Covid 19 (Corona Virus), directed Authorities to look into the needs of slums and also the homeless people.
When these two public importance Public Interest Litigation came to hearing, Division Bench observed that pursuant to our last order, report dated 19th of March, 2020 has been filed by the Financial Commissioner, Health and Medical Education Department of the Union Territory of Jammu and Kashmir, disclosing amongst others the following measuring which have been taken to address the contagion of COVID-19 in the Union Territory of Jammu and Kashmir.
It may be mentioned that one PIL by filed by Azra Usmail Vs UT of J&K and other and the other PIL is Court on its own motion vs UT of J&K & Others. Advocate General D C Raina with Additional Advocate Generals Aseem Sawhney and Amit Gupta appeared for the UT of J&K, Sr. Adv ZA Shah, Shah Aamir AAG appeared at Srinagar through Video Conference and submitted that the Govt of UT of J&K has taken all measures at war footing and the UT has issued J&K Epidemic Disease (COVOD 19) Regulations 2020 and declared COVID 19 as an epidemic disease. Further the advisories have been issued to DMs of the UT of J&K to avoid large gatherings and various DMs including Srinagar and Jammu have issued directions that no social, religious or ritualistic events shall be held at public/ community religious place having a gathering of more than 4 people. AG submitted that the orders under section 144 CrPC have been issued by the DMs of various DMs. Even the Yatra of Shree Mata Vaisho Devi has been suspended and on similar lines the religious leaders have been advised to suspend religious gatherings. All interstate bus services have been suspended and even the forien tourists have been advised not to visit J&K. Govt counsels submitted that 100% quarantine has been made for all visitors coming from UT of Ladakh, screening at Airports, Railway Stations and help desks made available, random screeing of buses at Lakhanpur, Lower Munda, No contact thermometers provided at Banganga and Sanjichat helipads, contact tracing of persons coming in contact with confirmed positive cases, home quarantine of Coronavirus suspects and being monitored by surveillance teams and medical personnell.
Advocate General DC Raina assisted by Aseem Sawhney, Amit Gupta and Shah Aamir AAsG submitted that the public at large is being made aware of the epidemic and many of steps taken.
Bench comprising of Chief Justice Gita Mittal and Justice Rajesh Bindal lauded and appreciated the efforts made by the Govt of J&K in open Court and exhorted upon the official respondents and the UT machinery to take more effective steps.
